On August 26, the Ministry of Public Security announced that the Criminal Investigation Agency of Bac Ninh Provincial Police has decided to prosecute and ban the director and deputy director of Dai Kim Limited Company from leaving their residence. The company is located in Xuan Binh, Nhan Hoa Ward, Bac Ninh Province, and the two are charged with tax evasion, causing billions of dong in state budget losses.
The director of Dai Kim Limited Company, Nguyen Van San (born 1977, residing in Nhan Hoa Ward, Bac Ninh Province), and his deputy, Bui Van Hung (born 1978, residing in Bao Dai Commune, Bac Ninh Province), are charged in connection with tax evasion in a criminal case of “Tax Evasion” initiated by the Criminal Investigation Agency of Bac Ninh Provincial Police on August 7.
Previously, Dai Kim Limited Company, directed by Nguyen Van San, had a business cooperation agreement with Bac Giang Thinh Phat Construction Investment Joint Stock Company, headed by Bui Van Hung. They agreed to jointly invest in bidding for the new residential area project in Bao Son Commune, Luc Nam District, Bac Giang Province (now Bao Dai Commune, Bac Ninh Province). Bui Van Hung was also appointed as deputy director of Dai Kim Limited Company, and profits were to be shared according to the capital contribution ratio.

In November 2020, Dai Kim Limited Company won the bid for the land use right to implement the new residential area project in Bao Son Commune, Luc Nam District, Bac Giang Province (now Bao Dai Commune, Bac Ninh Province), with an area of 64,235.8 square meters.
After obtaining approval from authorized agencies to sell the project land, San and Hung agreed to establish a contract for the transfer of land use rights with infrastructure and receipts at a selling price lower than the actual selling price. They then used this contract to issue value-added invoices and declare sales revenue, reducing actual sales revenue and the amount of tax to be paid, with the intention of evading taxes.
To date, Dai Kim Limited Company has signed 260 contracts for the transfer of land use rights with infrastructure and accompanying receipts. San instructed the accountant to issue value-added tax invoices and use the 260 contracts for the transfer of land use rights with infrastructure and receipts with values lower than the actual selling price to declare taxes to the tax authority.

Initially, the Criminal Investigation Agency of Bac Ninh Provincial Police determined that Dai Kim Limited Company had issued 206 value-added tax invoices for 103 land lots, declaring sales revenue and value-added tax lower than the actual sales revenue, thereby reducing the amount of value-added tax to be paid with the intention of tax evasion.
The difference between the total actual sales revenue and the total payment amount on the invoices exceeded VND 32 billion 333 million, causing a loss of more than VND 2 billion 929 million to the state budget.
