The Military Investigative Agency (CQĐTHS) under the Ministry of Defense has announced the conclusion of its investigation into a case involving “Violation of Land Management Regulations and Fraudulent Appropriation of Assets” in Khanh Hoa Province and several other related localities.
The agency sent the notification to the People’s Committee of Khanh Hoa Province, the Air Defense-Air Force Service, and individuals and organizations who are victims, involved parties in the case, or legal representatives of the involved parties.

According to the conclusion of the investigation, the CQ ĐTHS of the Ministry of Defense has transferred the case file to the Central Military Procuracy to propose the prosecution of the following accused: Nguyen Chien Thang, Le Duc Vinh (both former Chairmen of the People’s Committee of Khanh Hoa Province), Dao Cong Thien (former Vice Chairman of the People’s Committee of Khanh Hoa Province), Vo Tan Thai (former Director of the Department of Natural Resources and Environment of Khanh Hoa Province), and two other accused, Nguyen Duy Cuong and Hoang Viet Quang (former military officers).
The above-mentioned accused are charged with “Violation of Land Management Regulations” as stipulated in Clause 3, Article 229 of the Criminal Code.
The CQ ĐTHS of the Ministry of Defense also proposed the prosecution of Nguyen Van Hau, Tran Huu Dinh, and Nguyen Thi Hang (leaders of Phuc Son Corporation) for “Fraudulent Appropriation of Assets” as stipulated in Clause 4, Article 174 of the Criminal Code.
Previously, as we have informed, this case is related to the project of the urban, commercial, service, financial, and tourist center of Nha Trang (Khanh Hoa) invested by Phuc Son Joint Stock Company (Phuc Son Corporation).
The investigation determined that from 2016 to the present, Phuc Son Corporation, chaired by accused Nguyen Van Hau (known as Hau “pháo”), has collected more than VND 7,000 billion from customers through investment cooperation contracts and land transfer procedure contracts.
In October 2016, the People’s Committee of Khanh Hoa Province issued a decision to retrieve 62.3 hectares of land to assign to Phuc Son Corporation for the implementation of the project of the urban, commercial, service, financial, and tourist center of Nha Trang (including subdivisions 2A, 2, and 3), which is part of the old Nha Trang Airport area.
In 2017, Khanh Hoa Province authorized project management boards to sign BT contracts for three transportation projects with Phuc Son Corporation, including the Ngoc Hoi traffic junction, the belt road connecting to Ngoc Hoi traffic junction, and roads and traffic junctions connecting to Nha Trang Airport. The total investment for these three projects was VND 3,562 billion, and the investor was allowed to recoup their investment through more than 20 hectares of land in the old Nha Trang Airport area. All three BT projects were directly assigned to Phuc Son Corporation without going through an auction.
Phuc Son Corporation also has two other projects: Phuc Khanh 1 Urban Area (Vinh Trung, Nha Trang City) and Phuc Khanh 2 Urban Area (Dien An, Dien Khanh). Phuc Khanh 1 covers an area of nearly 14 hectares, and Phuc Khanh 2 covers an area of over 49 hectares. The planning for these projects at a scale of 1/500 was approved by the People’s Committee of Khanh Hoa Province in 2014. Although they have been deployed since 2014, both projects have not completed site clearance and compensation to date.
