The Ministry of Construction is seeking feedback on its draft Law on Construction, which includes proposals related to design, project management, investment costs, and regulations on construction permits.
Regarding construction permits, the Ministry proposes a one-time control principle, where from the preparation stage to the commencement of construction, the permitting authority will only review and approve once.
This means that for projects subject to assessment by specialized construction agencies, no construction permit is required. These include public investment projects, PPP projects, large-scale business investment projects, or projects with significant impacts on safety and community interests.
For the remaining projects, the construction permit procedure will be carried out by the state construction management agency.

Additionally, the Ministry aims to simplify the conditions, procedures, and processes for granting construction permits. This includes implementing fully online procedures for all projects, streamlining documentation requirements, and ensuring alignment with urban and rural planning and land-use purposes.
The Ministry also proposes enhancing the responsibility of design consulting units in ensuring the safety of works, while permitting authorities will focus on checking the results of the consulting units’ work.
Notably, the time for granting construction permits is expected to be reduced to a maximum of 7 days. Detailed provisions will be specified in the Decree guiding the implementation of the Law.
Conditions for Granting Construction Permits
According to the draft, there are three types of construction permits: new construction permits, repair/renovation/relocation permits, and temporary construction permits.
The draft stipulates that before the construction commencement, investors must obtain a construction permit, except for certain cases such as state secrets, emergency construction, special public investment projects, special investment procedure projects, and temporary construction as specified by law…
To obtain a construction permit, the project must conform to the approved urban and rural planning or technical sector planning. It should also align with the land use purpose as prescribed by land law.
Moreover, the design must ensure the safety of the work and adjacent works, comply with environmental protection regulations, and meet fire prevention and fighting requirements.
