The Lam Dong Provincial Department of Finance has recently reported to the Provincial People’s Committee on addressing citizens’ petitions regarding the Tan Viet Phat 2 Commercial, Service and Residential Project (Tan Viet Phat 2) in Phu Thuy Ward.

According to the report, citizen LTNG ( residing in Ho Chi Minh City) sent a petition to the Provincial People’s Committee requesting information on when the amount of over VND 45.3 billion paid by Tan Viet Phat Company to the provincial budget would be retrieved, and inquiring about the province’s plan to support investors in obtaining land use certificates and the timeline for construction at the project site.
Following the direction of the Chairman of the Provincial People’s Committee, the Department of Finance provided an update on the Tan Viet Phat 2 project, which was approved by the Binh Thuan Provincial People’s Committee (prior to reorganization) in 2018, with Tan Viet Phat Joint Stock Company as the investor.
Twelve officials related to this project have been prosecuted and sentenced, with a first-instance verdict announced on May 17, 2023, by the Hanoi People’s Court, and an appeal verdict on October 19, 2023, by the Hanoi High-Level People’s Court.
In December 2023, the Phan Thiet City Branch of the Department of Justice issued a decision: “Forcing Tan Viet Phat Joint Stock Company and its legal representative to refund over VND 45.3 billion to the Binh Thuan Provincial Budget”
The Department of Finance also mentioned that the Binh Thuan Provincial People’s Committee (prior to reorganization) had issued documents instructing the Department of Justice of Binh Thuan Province (now the Department of Justice of Lam Dong Province) to urgently organize the enforcement of the effective verdict to retrieve money and assets for the State. Additionally, the Department of Agriculture and Environment was assigned to coordinate and propose solutions to the Provincial People’s Committee regarding citizens’ petitions on land use certificates and construction at the project site.
Based on the above information, to ensure unified state management and provide a basis for responding to the citizen’s petition, the Department of Finance proposed that the Provincial People’s Committee direct the Department of Justice of Lam Dong Province to expedite the retrieval of money and assets for the State. The Department of Agriculture and Environment was assigned to take the lead in coordinating and reviewing the citizens’ petitions regarding land use certificates and construction at the project site, and to subsequently propose and report to the Provincial People’s Committee for consideration and direction.

According to the dossier, in 2017, after being allocated land, Tan Viet Phat Company invested in infrastructure development, dividing the land into 500 lots ranging from 100 m2 to 2,009 m2. The company signed cooperation investment contracts with customers in Hanoi, Ho Chi Minh City, and Dong Nai to mobilize capital for the transfer of 475 land lots.
The company collected 50% of the contract value from customers, with prices ranging from VND 6 million/m2 to VND 7.3 million/m2, resulting in a total mobilized capital of approximately VND 500 billion.
Some customers shared that many had paid up to 95% of the contract value, but the investor failed to deliver the land and transfer land use certificates for several years.
It is known that the Lam Dong Department of Justice has verified asset information to proceed with inventory and compulsory enforcement. The review identified 89 land use certificates, of which 23 are mortgaged at banks, 47 have been transferred, and 19 have unknown status.
Since the verdict took effect, this case has not yet been concluded. This situation not only challenges the enforcement agency but also serves as a significant lesson in ensuring transparency in land management.

According to the dossier, in 2017, the Binh Thuan Provincial People’s Committee allocated an area of over 92,000 m2 of land to Tan Viet Phat Company for the Tan Viet Phat 2 project but applied land prices from 2013, resulting in a loss of over VND 45 billion to the state budget. For this reason, 12 officials, including the former Chairman and two former Vice Chairmen of the Binh Thuan Provincial People’s Committee, were prosecuted, indicted, and tried. On July 23, 2022, Tan Viet Phat Company submitted a request to pay additional land money of VND 45 billion. The investigation agency agreed and provided guidance, but the company did not fulfill its commitment. During the May 2023 trial, the Hanoi People’s Procuracy determined that Tan Viet Phat Company benefited from the acts of the accused and pledged to return the amount of over VND 45 billion, but this has been delayed until now. |
