According to feedback from an official at the Department of Economic and Social Affairs, there are currently two differing viewpoints regarding the issuance of construction permits during the implementation of residential and urban development projects.
The first perspective argues that structures within investment construction projects, which have undergone feasibility study assessments by specialized agencies and are located in areas with detailed 1/500 scale planning, encompass only infrastructure, transportation, drainage, communication, and rough individual housing. This excludes individual housing in the form of subdivided land plots for sale.
Therefore, individual housing projects involving subdivided land plots for sale must apply for construction permits as per regulations.
The second viewpoint contends that structures within investment construction projects, assessed by specialized construction agencies through feasibility studies in areas with detailed 1/500 scale planning, include transportation, infrastructure, drainage, communication, rough individual housing, and individual housing in subdivided land plots for sale.
Thus, individual housing projects in subdivided land plots for sale within residential and urban areas are exempt from requiring construction permits.
The official requests the Ministry of Construction to provide specific guidance for local authorities to implement the regulations accurately.

In response, the Ministry of Construction clarifies that for residential projects aimed at developing infrastructure and transferring land to households or individuals for self-built housing, with approved detailed 1/500 scale planning, recipients of land transfers for self-built housing are not exempt from construction permits.
This regulation is based on the 2014 Construction Law and the Law Amending and Supplementing a Number of Articles of the Construction Law No. 62/2020/QH14, except as specified in Clause 2, Point i, Article 89.
