Government Issues Resolution to Untangle Land Use Planning Bottlenecks

The Vietnamese government has issued Resolution No. 66.3/2025/NQ-CP dated September 15, 2025, aimed at addressing and resolving obstacles to implement projects during the period of the National Land Use Plan for 2021–2030, with a vision toward 2050, pending approval of its adjusted version.

The resolution outlines procedures for addressing land use cases where conflicts arise between different planning schemes or where usage does not align with approved plans.

According to the resolution, provincial People’s Committees will allocate land use quotas to communes based on the 2021–2030 Provincial Planning, with a vision to 2050, approved before July 1, 2025, following administrative unit reorganizations.

Notably, this allocation is not constrained by the quotas in the National Land Use Planning previously approved by the National Assembly. This is expected to grant localities greater autonomy in land management, preventing bottlenecks caused by delays in adjusting national-level quotas.

Resolving Conflicts Between Planning Schemes

The resolution also establishes principles for handling land use cases involving overlaps or conflicts between different planning schemes.

If a project is included in a national sectoral plan, aligns with land use plans or urban/rural planning, but conflicts with other sectoral plans, the competent authority will prioritize the land use plan when processing land allocation, leasing, or purpose conversion procedures.

For projects related to national defense or security, the Minister of Defense or Minister of Public Security must consult local authorities. If disagreements persist, the Prime Minister will make the final decision.

For projects with investment approval requiring the reclamation of defense or security land for transfer to local authorities, provincial People’s Committees must seek input from the Ministry of Defense or Ministry of Public Security before proceeding.

Preventing Bottlenecks in Key Projects

Land areas reclaimed under this resolution’s mechanism will be updated during future planning adjustments and reviews.

The resolution takes effect immediately upon signing (September 15, 2025) and remains valid until February 28, 2027. If new laws or resolutions on national land use planning adjustments are issued by the National Assembly or Government during this period, the corresponding provisions in Resolution 66.3 will cease to apply.

With these innovations, the resolution is expected to resolve numerous land management bottlenecks, ensuring timely implementation of projects, particularly critical infrastructure, urban development, and key economic zones nationwide.

Amid concerns about delays in major infrastructure and socio-economic projects due to land planning issues, Resolution 66.3 acts as a “pressure relief valve,” enabling flexible procedure resolution while maintaining legal compliance.
