Latest Developments in the ‘Mistakenly Built House’ Case on Another’s Land in Hai Phong

Instead of returning the land to the rightful owner, Mr. Do Van Huu, a resident of Thien Huong Ward, Hai Phong City, has filed an appeal against the first-instance civil judgment in the case of "mistakenly building a house" on someone else's land, where he is the defendant. The Hai Phong City People's Court has accepted Mr. Huu's appeal. While this tactic is within the defendant's rights, it is also seen as a strategy to prolong the resolution of the case.

On September 22, in a conversation with Tien Phong newspaper, a representative from the leadership of Thien Huong Ward (Hai Phong City) revealed that the local authorities had communicated with the Hai Phong City People’s Court. The court confirmed receiving an appeal from Mr. Do Van Huu against the first-instance judgment No. 08/2025 issued by the District 1 People’s Court regarding the case of “mistakenly building” a house on someone else’s land.

Before the Hai Phong City People’s Court hears the appeal, local authorities are actively collaborating with inter-agency forces to mediate between the two families. The goal is to reach a mutually agreed resolution, minimize damages, and ensure compliance with legal regulations.

Additionally, the Economic-Infrastructure and Urban Department under the Ward People’s Committee has been tasked with providing counsel and reporting to the City People’s Committee and relevant agencies in case of complex developments.

According to the representative from Thien Huong Ward’s leadership, verification results show that on September 23, 2024, Ms. Tran Thi Kim Loan purchased a 60-square-meter plot of land in Village 7, Kien Bai Commune (Thuy Nguyen District, Hai Phong City), now known as Residential Area 7, Thien Huong Ward.

On October 19, 2024, Ms. Loan was issued a land use rights certificate by the Thuy Nguyen District People’s Committee for the aforementioned plot.

The mistakenly built house on another’s land in Thien Huong Ward (Hai Phong City) has sparked public outrage.

However, on November 20, 2024, Ms. Loan’s family discovered that their newly purchased land had been occupied by Mr. Do Van Huu’s family (from Village 7, Kien Bai Commune), who had constructed a two-story house on it. Ms. Loan immediately reported the matter to local authorities.

The following day, the Kien Bai Commune People’s Committee conducted an inspection and invited both parties for a meeting. During the meeting, Mr. Do Van Huu admitted to building the house on Ms. Loan’s land due to a mistake, as his family had also purchased a plot located four plots away from Ms. Loan’s land.

Mr. Tran Van Duong, Chairman of the Kien Bai Commune People’s Committee at the time, ordered Mr. Do Van Huu to halt construction on Ms. Loan’s land.

Despite this, a week later, a task force from the Commune People’s Committee found that construction on the “mistakenly built” house was still ongoing. The task force issued a record and reiterated the demand for Mr. Do Van Huu to stop construction.

Ignoring repeated orders from local authorities, Mr. Do Van Huu continued to build and complete the two-story house. Ms. Loan’s family subsequently filed a lawsuit in court.

On August 11, 2025, the District 1 People’s Court of Hai Phong City held a first-instance trial, ruling that Mr. Do Van Huu must remove all belongings and dismantle the entire structure to return the land to Ms. Loan’s family.

On September 15, 2025, the Thien Huong Ward People’s Committee held a meeting regarding the case. The committee affirmed that the land with the mistakenly built house belongs to Ms. Tran Thi Kim Loan, as evidenced by her land use rights certificate. They also demanded that Mr. Do Van Huu comply with the first-instance judgment of the District 1 People’s Court once it takes effect.

Why did the “mistakenly built house” incident occur?

According to local residents, Mr. Do Van Huu’s plot is located four plots away from Ms. Tran Thi Kim Loan’s land, both situated in the same row in Village 7, Kien Bai Commune (Thuy Nguyen District), now Thien Huong Ward (Hai Phong City). Notably, the area behind Mr. Do Van Huu’s plot is less desirable due to its proximity to a local cemetery.
