The Intellectual Property Office (Ministry of Science and Technology) has issued Decision No. 203462, recognizing intellectual property rights and granting Trademark Registration Certificate No. 570005 to Binh Minh Vietnam Plastic Joint Stock Company. This decision is based on the application submitted on November 28, 2022.

This move concludes a lengthy and contentious legal battle between Binh Minh Plastic Joint Stock Company and Binh Minh Vietnam Plastic Joint Stock Company over intellectual property rights.

Previously, after filing the application for the trademark certificate, Binh Minh Vietnam Plastic was sued by Binh Minh Plastic for intellectual property disputes.

In the first-instance judgment dated July 12, 2024, the Ho Chi Minh City People’s Court ruled that the logos of the plaintiff and defendant were not identical or similar; the company names were clearly distinguishable. Therefore, there was no basis to claim that Binh Minh Vietnam Plastic infringed on Binh Minh Plastic’s intellectual property rights. The court dismissed all claims by the plaintiff.

In April 2025, the High People’s Court in Ho Chi Minh City upheld the first-instance judgment in the appellate trial. The judges concluded that the logos and labels on the plastic pipes of both parties were entirely different and did not overlap, thus not violating Article 129, Clause 1(c) of the Intellectual Property Law. While both logos featured the term “BÌNH MINH,” the font size, style, and product origins were distinct, causing no confusion among consumers.
