In response to VTC News’ report regarding a rare incident where a household lost nearly 100m² of residential land due to a clerical error, Mr. Nguyễn Trần Dương, Vice Chairman of An Dương Ward People’s Committee in Hai Phong City, stated that upon receiving the information, local authorities conducted a thorough review.
According to Mr. Dương, when the An Dương Land Registration Office transferred the file to the ward, the unit was not immediately provided with the duplicate file set and there was no report on the land plot’s changes. This necessitated a complete re-examination of the records, resulting in significant delays.
Hai Phong authorities are processing corrections for the missing area in the land use rights certificate issued to Mr. Chu Đức Luân’s family in An Dương Ward.
Mr. Dương clarified that this procedure is not for issuing a new certificate but for correcting information, which falls under the jurisdiction of the An Dương Land Registration Office.
Specifically, Article 24 of Decree 101 states:
Handling the issuance of land use rights certificates and property ownership certificates for land plots with increased area due to boundary changes compared to existing land documents or issued certificates.
“In the documents provided by the family to the An Dương Land Registration Office, the excerpted measurement section describing boundary changes since the certificate was issued was left blank, indicating no boundary changes. Without boundary changes, Article 24 cannot be applied,”
Mr. Dương explained.
Consequently, the An Dương Ward People’s Committee submitted a document citing legal provisions to the An Dương Land Registration Office, urging them to reaccept Mr. Chu Đức Luân’s family’s file and resolve the issue within their authority.
After receiving the file from the ward, the Land Registration Office processed the additional area, forwarded the file to tax authorities to determine additional fees, and initiated corrections to the land use rights certificate.
Mr. Luân’s land use rights certificate shows 367m², but calculations based on the provided dimensions and actual usage indicate a shortfall of nearly 100m².
Previously, VTC News highlighted the unusual case of Mr. Chu Đức Luân (born in 1942, residing in Area 6, An Dương Ward, Hai Phong City), who lost nearly 100m² of residential land due to a calculation error, despite the dimensions being recorded in the land certificate.
Specifically, land plot 289A +289A2 on map sheet 8 in Area 6, An Dương Town, Hai Phong City, was certified by the former An Dương District People’s Committee under Certificate No. CH00206 on November 14, 2017, signed by Mr. Nguyễn Trường Sơn, then Vice Chairman. The total area was 580.5m².
The certificate includes areas of 213.5m² and 367m². However, calculating the 367m² section using the provided dimensions and actual usage yields 466.2m², a discrepancy of 99.2m².
In 2025, when Mr. Luân planned to divide the land among his children and commissioned a remeasurement, the 99.2m² shortfall was discovered. After identifying the error, his family initiated correction procedures, with the An Dương District Land Registration Office conducting measurements under the supervision of Mr. Phạm Quang Chung, then Land Officer of Lê Lợi Ward.
Despite no increase in dimensions and a reduction due to Mr. Luân’s voluntary setback, the remeasurement added 86.7m² to the original area.
The remeasurement revealed an 86.7m² increase, even though most dimensions remained unchanged and two adjacent to neighbors decreased due to Mr. Luân’s voluntary setback.
The new excerpt was signed by the Chairman of Lê Lợi Ward on May 6, 2025, and by the Director of the An Dương District Land Registration Office, Mr. Nguyễn Anh Túy, on May 9, 2025.
Despite months of engagement with authorities, Mr. Luân’s family has not received resolution, reportedly due to staff shortages in the land management department of An Dương Ward.
Latest Developments in the ‘Mistakenly Built House’ Case on Another’s Land in Hai Phong
Instead of returning the land to the rightful owner, Mr. Do Van Huu, a resident of Thien Huong Ward, Hai Phong City, has filed an appeal against the first-instance civil judgment in the case of “mistakenly building a house” on someone else’s land, where he is the defendant. The Hai Phong City People’s Court has accepted Mr. Huu’s appeal. While this tactic is within the defendant’s rights, it is also seen as a strategy to prolong the resolution of the case.
