The Ministry of Agriculture and Environment has recently issued a decision announcing new internal administrative procedures and amendments in the land management sector under its state management authority. The decision includes four new internal administrative procedures and three amended ones.
Specifically, among the four new internal land-related procedures, three pertain to land reclamation at the commune level, and one is implemented at the provincial level.

Starting September 25, commune authorities will handle three additional new land-related administrative procedures.
Accordingly, from September 25, commune authorities will reclaim land from households, individuals, and community residents in cases of land law violations as stipulated in Article 81 of the Land Law.
Land reclamation due to termination of land use as per the law, voluntary land return, threats to human life, or inability to continue land use under clauses 1, 2, and 3 of Article 82 of the Land Law will also be handled at the commune level.
Commune authorities will also reclaim land in cases specified under clause 1 of Article 48 of the Land Law.
Meanwhile, provincial authorities will implement a new procedure for land reclamation from domestic organizations, religious organizations, affiliated religious organizations, overseas Vietnamese, foreign organizations with diplomatic functions, and foreign-invested economic organizations in cases of land law violations.
The Ministry of Agriculture and Environment also announced amendments to three procedures within its functional scope.
First, the procedure for establishing the initial land price list for publication and application from January 1, 2026, and the annual adjustment, amendment, and supplementation of the land price list for publication and application from January 1 of the following year at the provincial level. The authority to decide on the land price list has shifted from the Provincial People’s Committee to the Provincial People’s Council.
Second, the procedure for specific land valuation in cases under the jurisdiction of the Chairman of the Provincial People’s Committee.
Third, the procedure for specific land valuation in cases under the jurisdiction of the Chairman of the Commune People’s Committee.
Revolutionary Land Price Table Construction Changes Effective January 1, 2026
Under the new regulations, the process and procedures for establishing land price lists at the provincial level, to be announced and applied from January 1, 2026, will follow a 16-step sequence. The authority to determine land prices has shifted from the Provincial People’s Committee (UBND) to the Provincial People’s Council (HĐND).

Additionally, it abolishes all investment and business conditions for 10 conditional business sectors within the construction field, as outlined in the Investment Law.
