Ho Chi Minh City Prepares New Sidewalk Fee Proposal

Ho Chi Minh City mandates a comprehensive review and repeal of any unsuitable regulations, while also initiating a study on the Management, Exploitation, and Utilization Plan for Roadways and Sidewalks within the city’s jurisdiction.

The Ho Chi Minh City People’s Committee Office has announced the conclusion of Vice Chairman Bui Xuan Cuong regarding the management and temporary use of road and sidewalk spaces in the city.

The Vice Chairman directed the Department of Construction to collaborate with relevant agencies and urgently work with the Department of Justice to abolish outdated content in Decisions No. 32/2023 and No. 45/2023, submitting the revised version to the People’s Committee by October.

Simultaneously, they are to review fee regulations for temporary road and sidewalk usage in Ho Chi Minh City, as per the People’s Council Resolutions, and address any inconsistencies. The revised proposal is to be submitted to the People’s Council by November.

Ho Chi Minh City has suspended sidewalk fees

The Department of Construction is also tasked with reviewing and proposing amendments to Decree No. 44/2024/NĐ-CP and Decree No. 165/2024/NĐ-CP, in collaboration with the Department of Justice and the Department of Finance, to enhance the management and utilization of road and sidewalk spaces in the city.

They are to assess the legal basis and necessity of a scheme for managing and utilizing road and sidewalk spaces, in cooperation with the City Development Research Institute, and report the findings to the People’s Committee by October.

The Department of Construction, in conjunction with the Department of Justice, is to promptly advise the Chairman of the People’s Committee to issue a directive assigning specific tasks to district-level People’s Committees and relevant agencies to strengthen the management and temporary use of road and sidewalk spaces in accordance with the law. This is to be completed by October 15th.

In a statement to PLO, a representative from Tan Dinh Ward People’s Committee mentioned that before the merger, sidewalk fees were collected under Decision 32. In the former District 1, there were 9 sidewalks where fees were implemented.

Currently, Tan Dinh Ward has 41 streets, but the city has not yet provided specific guidelines for sidewalk usage or road and sidewalk rentals. The Ward People’s Committee is awaiting instructions from the Ho Chi Minh City People’s Committee.

On January 1, 2024, Ho Chi Minh City began collecting fees for sidewalk and road usage as per Resolution 15/2023/NQ-HĐND.

As of January 1, 2025, the new Road Traffic Law and Road Traffic Order and Safety Law took effect, replacing previous regulations.

The new laws no longer grant provincial-level People’s Committees the authority to regulate road and sidewalk usage or permit business activities on sidewalks. Consequently, Ho Chi Minh City has halted sidewalk fees and is adjusting its policies to align with the new legal framework.
