North Ninh: Auditing Down Payment Collection and Surcharges for Social Housing Transactions

The Chairman of the People’s Committee of Bac Ninh Province has mandated the investigation and resolution of reports regarding alleged practices such as "promising units, holding deposits, collecting down payments, and demanding additional fees" within a social housing project.

According to the Bac Ninh Province’s Electronic Information Portal, in Document No. 3147/UBND-KTN, Chairman of the Bac Ninh Provincial People’s Committee, Vuong Quoc Tuan, has directed the handling and resolution of reports regarding “promises, holding units, deposit collection, and surcharge fees” related to the Social Housing Project No. 02 in Area 5 and Area 9 of the Southern Urban Area, Bac Giang City (formerly known as Bac Giang Town).

Specifically, the Chairman has instructed the Department of Construction to closely monitor the project’s implementation by the developer and promptly report any issues or obstacles to the Provincial People’s Committee for further guidance.

Additionally, the Chairman has called for the exploration of additional channels to receive applications and information from buyers, particularly state agencies and socio-political organizations. Consideration is also being given to banning the sale of social housing units through real estate agencies.

The Bac Ninh Provincial Police, in collaboration with the Department of Construction, the People’s Committees of Bac Giang Ward and Tan Tien Ward, and relevant agencies, are tasked with inspecting and addressing organizations and individuals involved in brokerage activities, including “promises, holding units, deposit collection, and surcharge fees” at the project site. They are also responsible for proactively inspecting, penalizing, and removing or recommending the removal of fraudulent websites and fan pages that post unauthorized housing sale information, ensuring compliance with official developer channels.

The Chairman of Bac Ninh Province has also directed the People’s Committees of Bac Giang Ward and Tan Tien Ward to enhance public awareness by disclosing project planning details, eligibility criteria for purchasing or renting units, and advising residents against engaging in real estate transactions related to the project until all regulatory conditions are met.

Inspections and enforcement actions will be conducted against real estate advisory and brokerage points located near the project. Unauthorized advisory and brokerage points occupying sidewalks or local land plots will be dismantled, and the areas will be restored to ensure compliance with urban aesthetics and order regulations.

The Capital Investment and Trading Joint Stock Company is urged to expedite the construction progress of the social housing project to increase market supply. The company must also urgently finalize and approve the selling prices in accordance with regulations.

All real estate transactions must strictly adhere to legal requirements, with a strict prohibition on illegal capital mobilization. Sales of future housing units within the project must meet all conditions and receive written confirmation from the Department of Construction before proceeding.

Continuous monitoring and reporting to competent authorities are required to prevent unauthorized organizations or individuals from impersonating the developer or engaging in real estate transactions related to the project without a valid service contract with the developer.

The Bac Ninh Provincial Tax Department is tasked with reviewing real estate trading platforms operating in the area, imposing penalties for non-compliance with business registration requirements, and strengthening tax declaration management for these platforms.
