The Fate of Nha Trang’s Prime Coastal Development Projects

Prime beachfront properties along Nha Trang's coastline in Khanh Hoa province, marred by numerous violations, are now under scrutiny. Authorities are urging corrective actions and removals to prevent further waste of these valuable land resources.

The Khanh Hoa Provincial Inspectorate has recently issued four specialized inspection conclusions regarding projects facing difficulties, delays, and low efficiency across the province. Numerous projects utilizing prime coastal land in Nha Trang have exposed a series of violations.

Abandoned Prime Land

One of the hotspots is the land plot at 70 Tran Phu Street (Nha Trang City), a prime location left abandoned for years due to complications with two BT projects. These include the Antenna Tower Project of Khanh Hoa Radio and Television Station (covering 5,414 m² with a budget of 90 billion VND) and the Station’s Office Building Project (spanning over 23,303 m² with a budget of 136 billion VND). The projects are led by a consortium of Phuong Dong Urban Construction JSC and Cotana Group JSC.

The repayment to investors was intended to be made through the former land of the Radio and Television Station at 70 Tran Phu. However, the BT contract signed in 2014 did not comply with legal regulations. It wasn’t until 2015 that the Prime Minister issued Decision No. 23/2015/QD-TTg, outlining the mechanism for BT payments using land funds.

Thus, the provincial People’s Committee’s use of the land at 70 Tran Phu to compensate investors, while formally aligning with the later decision, did not adhere to the Prime Minister’s directives.

The Inspectorate identified the responsibility lying with the provincial People’s Committee (2013–2016), the Department of Finance (2013–2018), and several related individuals. Additionally, the 2018 BT contract for the Station’s Office Building was found to violate regulations: the provincial People’s Committee allocated construction land not in line with planning and outside Nha Trang City’s 2018 land use plan. Responsibility falls on the provincial People’s Committee, the Department of Natural Resources and Environment, and related individuals.

The Provincial Inspectorate recommends that the Khanh Hoa People’s Committee direct the study and proposal of a land use rights auction plan, along with project settlement to compensate investors in accordance with the law.

Fixed Pricing

The BT project for the construction of Nha Trang Vocational College in Phuoc Dong Commune (covering 7.4 hectares with a total budget of 295.6 billion VND) was signed with Vinaminco Khanh Hoa JSC in 2015.

According to the BT contract, the investor would be compensated with the former campus at 32 Tran Phu, a high-value beachfront plot where the developer planned the Sunshine Marina Nha Trang project. This project fixed the land value at 32 Tran Phu at over 271 billion VND.

The inspection revealed that the Department of Finance’s advice on using former land assets for BT project payments did not comply with the Prime Minister’s regulations under Decision No. 09/2007/QD-TTg dated January 19, 2007. The project announcement process also failed to align with the stipulated timeline.

Clause 5.2 of Article 5 in the BT contract states: “The land use rights value and investment rights for the project are fixed at 271,738,000,000 VND…”. As of the inspection date, no land had been handed over or leased to the investor, rendering the implementation of Clause 5.2 non-compliant with the Land Law.

The plot at 32 Tran Phu, a high-value beachfront site, is slated for the Sunshine Marina Nha Trang project.

Given the numerous violations and obstacles, the Khanh Hoa Provincial Inspectorate urges the provincial People’s Committee to direct relevant departments in devising solutions, following Directive 751 guidelines and awaiting the Government’s resolution to address BT project challenges.

After the Government issues the resolution, the Inspectorate recommends that the provincial People’s Committee instruct relevant departments to facilitate land handover to investors, determine specific land values for BT project settlements in compliance with the law, and execute land-based payments to investors as per the Government’s resolution and central ministry guidelines.

The Provincial Inspectorate proposes that the Chairman of the provincial People’s Committee require involved agencies, organizations, and individuals to implement the inspection conclusions and report back by October 30, 2025, with copies sent to the Inspectorate for monitoring.

28 Projects Suspended from Inspection

Among the four inspection conclusions, 28 projects were excluded from the inspection scope (suspended). These include other prime coastal projects such as the Tropicana Nha Trang Complex at 40 Tran Phu, the Starcity Beachfront Hotel at 72-74 Tran Phu, and the Horizon Nha Trang Hotel on Pham Van Dong Beachfront…

The Tropicana Nha Trang Complex at 40 Tran Phu has been abandoned for five years.

The Provincial Inspectorate recommends that the Chairman of the provincial People’s Committee direct the Inspectorate and relevant departments to devise measures to resolve project bottlenecks, thereby unlocking resources and fostering socio-economic development in Khanh Hoa.
