In early September, the Thanh Hóa Provincial People’s Procuracy announced the approval of an arrest warrant and search order for H.V.Đ., a prominent YouTuber from Thanh Hóa, on charges of “Tax Evasion.” The total evaded amount in VAT and personal income tax exceeded VND 120 million.
Previously, in July, law enforcement authorities detained Nguyễn Thị Thu Hường (Hycloset). Initial findings indicated her business generated substantial revenue, surpassing VND 834 billion. However, she failed to declare and pay taxes as required, evading over VND 12.5 billion.
In June, TikToker Vũ Hồng Phúc, known as ‘Cún Bông,’ and her husband were charged with falsely declaring revenue to evade taxes, causing a loss of over VND 10 billion to the state.
What can we learn from Hoàng Hường and other KOLs’ cases?
A tax expert commented that these cases serve as a stark warning to the business community, particularly those operating online. “Most online transactions are conducted via bank transfers, making it easier to trace financial flows. Tax evasion is not only unfeasible but also carries significant legal risks. Compliance with tax laws ensures sustainable and efficient business operations,” the expert advised.
For sellers unfamiliar with tax regulations or those previously operating under a presumptive tax system, experts recommend seeking guidance from tax authorities to ensure accurate declarations and avoid legal pitfalls.
Đỗ Quang Huy, an e-commerce expert and Director of Ecotop Company, warned that further tax violations would be uncovered. He identified two primary causes: intentional acts, such as splitting revenue across multiple accounts and falsifying records, and a lack of tax and financial knowledge leading to errors or omissions.
Historically, many sellers under the presumptive tax system were unaware of their actual revenue. With the shift to bank transactions, revenue tracking has become more transparent and manageable.
Huy also noted that products like milk and dietary supplements of unclear origin often have high-profit margins, leading to aggressive advertising campaigns and appealing online presentations. This strategy has been exploited by many KOLs to influence consumer behavior.
Experts caution consumers to remain vigilant against “miraculous” product claims and not to trust influencers blindly. High view counts or large followings do not guarantee product quality.
Advertisements promising rapid cures for conditions like joint pain or gout, or those discouraging medical treatment, are often misleading. Consumers should report suspicious claims to authorities.
