Can Individuals Without Employment Contracts Still Purchase Social Housing?

The Ministry of Construction has proposed amendments to the decree, suggesting that individuals without formal employment contracts should still be eligible for social housing, provided they obtain confirmation from local commune-level police authorities.

On the afternoon of October 10, Deputy Prime Minister Tran Hong Ha chaired a meeting to review the draft decree amending and supplementing certain provisions of Decree 100/2024 and Decree 192/2025. These decrees provide detailed regulations on the implementation of the Social Housing Development and Management Law and pilot mechanisms for special policies in social housing development, as outlined in National Assembly Resolution 201/2025.

According to the Ministry of Construction’s report, the draft decree focuses on clarifying income eligibility criteria for individuals purchasing or renting social housing.

The proposed income thresholds are set at VND 20 million/month for individuals, VND 40 million/month for married couples, and VND 30 million/month for single individuals supporting underage children.

Based on regional income conditions, provincial and city authorities will adjust eligibility criteria for social housing applicants.

Notably, individuals without formal employment contracts can still access social housing, provided they obtain confirmation from local police based on the national population database. This proposal aligns more closely with the actual income and living conditions of citizens.

The interest rate for social housing loans is set at 5.4% per annum. Any adjustments to this rate must be reported to the Prime Minister for approval.

A key highlight of the draft decree is the amendment allowing developers to pay a fee instead of allocating 20% of their project land for social housing construction.

This change aims to address existing shortcomings, ensuring transparency, fairness, and accurate targeting in social housing programs.

The decree also stipulates that land use fees for the entire project will follow current land law regulations. Additional payments for the 20% land area will be calculated at 3% per annum of the land use fee, based on the approved infrastructure completion schedule.

The Ministry of Construction believes this regulation will prevent businesses from exploiting the fee option while ensuring a stable funding source for social housing development. Linking payments to infrastructure progress promotes fairness and prevents budget shortfalls.

During the meeting, the Ministry of Construction sought input on selecting social housing project developers when multiple qualified investors apply. Deputy Prime Minister Tran Hong Ha emphasized the need for a transparent, public bidding process in such cases.

The Deputy Prime Minister also instructed the Ministry to introduce incentives for multi-generational households and families with three or more children to access social housing.

He directed the Ministry of Construction to expedite the draft’s finalization, thoroughly review its content, and prepare the submission dossier for the Prime Minister’s approval.
