Asset Recovery Information in a High-Profile Case in Lam Dong

Over 45 billion VND, mandated by the court for enforcement at the Tan Viet Phat 2 project, remains unpaid to the state budget despite years since the verdict was issued.

On October 17th, it was reported that the Department of Justice in Lam Dong Province has submitted a specialized report on the recovery of lost and embezzled assets in cases involving corruption, waste, and misconduct.

According to the report, from 2021 to June 2025, Lam Dong Province handled a total of 89 enforcement cases, including 18 cases carried over from the previous period.

To date, 15 cases remain pending enforcement. Among these, 2 cases are under the direct supervision of the Provincial Steering Committee, while 4 cases are monitored by the Central Steering Committee on Anti-Corruption and Negativity.

Notably, one case involves the enforcement of a judgment exceeding 45 billion VND at Tan Viet Phat Joint Stock Company.

According to the case file, during the enforcement process of the court’s decision requiring the payment of over 45 billion VND to the state budget, Mr. Nguyen Ngoc Phuong, Director of Tan Viet Phat Joint Stock Company, requested the Civil Judgment Execution Department of Binh Thuan Province (formerly) to restrict transactions on 500 land plots. These plots, totaling 57,000 square meters, are part of the Tan Viet Phat 2 project and have been issued Land Use Rights Certificates to the company, ensuring compliance with the enforcement order.

In July 2024, representatives of Tan Viet Phat Joint Stock Company informed the Civil Judgment Execution Department that the company is negotiating with partners to transfer shares, aiming to secure funds to fulfill the court’s judgment.

On July 5, 2024, the Director of the Civil Judgment Execution Department issued a decision temporarily prohibiting Mr. Nguyen Ngoc Phuong, CEO of Tan Viet Phat Joint Stock Company, from leaving the country.

During the investigation, the Civil Judgment Execution Department discovered that Tan Viet Phat Joint Stock Company maintains multiple bank accounts. However, inquiries with the relevant banks revealed that the balances in these accounts are minimal, sufficient only to maintain the accounts.

In April 2025, during a meeting with the People’s Committee of Binh Thuan Province (formerly), the leadership of Tan Viet Phat Joint Stock Company committed to mobilizing resources to enforce the payment of over 45 billion VND by May 2025.

However, as of early October 2025, the company has yet to remit the over 45 billion VND to the state budget, as mandated by the court’s decision to rectify the consequences of the case.
