Recently, the Office of the Ho Chi Minh City People’s Committee issued a directive from Vice Chairman Bui Xuan Cuong, instructing the Department of Construction to streamline the process for issuing construction permits and exempt single-family homes from requiring construction permits within the city.

Specifically, the Vice Chairman tasked the Department of Construction with leading efforts, in collaboration with relevant agencies, to propose simplified procedures for construction permits and exemptions for single-family homes. These proposals will be based on the city’s unique characteristics and submitted to the People’s Committee for implementation in the near future.

Notably, instead of issuing permits, the Department of Construction will support and guide district-level People’s Committees to transition to a paperless system, accepting and processing permit applications exclusively online. This will be facilitated through an interconnected network with the Department to enhance monitoring and oversight of construction permits across the city.

Additionally, the Department of Construction is responsible for publishing a comprehensive guide detailing the required documents and procedures for obtaining construction permits for single-family homes. This guide will ensure uniform implementation across all districts in the city.

The People’s Committee also directed the Department of Planning and Architecture to review and report on the implementation of Decision No. 56/2021, which outlines the city’s architectural management regulations.

Previously, the Department of Construction advised the People’s Committee to petition the Prime Minister and the Ministry of Construction for a pilot program exempting construction permits for single-family homes under seven stories in areas with approved 1/500 detailed planning or urban design.

Furthermore, the Department proposed extending this exemption to areas with approved urban designs, provided they meet the planning and architectural criteria equivalent to 1/500 detailed planning requirements.

During a recent government press conference, Deputy Minister of Construction Nguyen Danh Huy emphasized the Party’s commitment to maximizing convenience for citizens and businesses. The Ministry of Construction is actively reviewing, simplifying, and eliminating administrative procedures to support this goal.

In practice, the policy of exempting construction permits for projects with 1/500 detailed planning or within approved urban design areas was outlined in the Prime Minister’s Directive dated May 29.

Subsequently, the Chairman of the Ho Chi Minh City People’s Committee instructed the Department of Construction to issue detailed guidelines for this process, considering alleyway boundaries and the city’s architectural management regulations.

What’s Required to Qualify for a Construction Permit Exemption?

To date, the Department of Construction has published a list of 118 projects eligible for permit exemptions and continues to review additional cases.

To qualify for an exemption, individuals or organizations must hold legal land-use rights for residential purposes. Construction is prohibited on disputed land or properties subject to legal restrictions or transfer prohibitions.

Additionally, construction must adhere to the architectural and planning standards outlined in the approved 1/500 detailed planning or site plan. Notably, at least three days before commencing construction, individuals or organizations must notify the local construction management authority of the start date and submit the construction design documents.
