Minister of Home Affairs Pham Thi Thanh Tra, Deputy Standing Head of the Steering Committee for the Reorganization of Administrative Units at All Levels and the Development of the Two-Tier Local Government Model (the Steering Committee), has issued Official Dispatch 20. This dispatch outlines the establishment of a public service unit providing multi-sectoral and multi-disciplinary public services at the commune level.
Based on local realities
Previously, on October 8, the Steering Committee issued Official Dispatch 145 regarding the consolidation of the agricultural extension system at the local level. The dispatch urged the People’s Committees of provinces and centrally-run cities to expeditiously implement assigned tasks, ensuring compliance with the required timeline.
Pending the issuance of a Government Decree amending and supplementing certain provisions of Decree 120/2020 on the establishment, reorganization, and dissolution of public service units, the Steering Committee, based on recommendations from several localities, has provided specific guidance on the establishment and operation of public service units under the commune-level People’s Committees. These units, funded by the state budget, will provide essential, multi-sectoral, and multi-disciplinary public services.

Specifically, regarding the authority to establish such units, the Steering Committee recommends that provincial-level People’s Committees, based on the Law on Organization of Local Governments, direct commune-level People’s Committees to decide on the establishment of a public service unit within their jurisdiction. This unit will provide essential, multi-sectoral, and multi-disciplinary public services, including culture, sports, tourism, information, communication, environment, agricultural extension, and urban services, all funded by the state budget.
In cases where a commune-level People’s Committee has already established a public service unit funded by the state budget to provide essential public services, it is recommended to reorganize and supplement agricultural extension tasks as required.
According to the dispatch, based on the practical needs of the locality, provincial-level People’s Committees shall provide guidance on the name, organizational structure, functions, tasks, and authority of the public service unit providing multi-sectoral and multi-disciplinary public services at the commune level.
This guidance should fully outline the tasks and authority of the public service unit in providing essential public services across various sectors assigned to it within the commune. It should ensure alignment with the guidance of the specialized managing ministry and the emerging needs of the commune.
Regulations on the number of deputy heads
The establishment of departments within the public service unit must ensure that each department handles at least two work areas and has a distinct management process tailored to its managed entities. Additionally, each department must have a minimum of seven staff members who are civil servants.
“The number of deputy heads of the public service unit shall not exceed two; the number of deputy heads of departments within the unit shall be one,” Official Dispatch 20 specifies.
Regarding staffing levels, based on the total number of civil servant positions funded by the state budget (excluding positions in education and healthcare) allocated by the competent authority, provincial-level People’s Committees are requested to review, balance, and allocate the number of staff positions funded by the state budget when establishing this public service unit at the commune level.
During implementation, commune-level People’s Committees are responsible for recruiting and assigning sufficient civil servants to the public service unit according to the allocated staffing levels.
In cases where timely recruitment of civil servants according to the allocated number is not feasible, commune-level People’s Committees may enter into labor contracts with individuals possessing the necessary expertise and qualifications to immediately fulfill the required tasks, as stipulated in Decree 111/2022.
