During the 10th session of the National Assembly on the morning of October 22, Minister of Home Affairs Pham Thi Thanh Tra presented the revised Civil Servant Law. The proposed law focuses on civil servants hired under contract-based employment in public service units, receiving salaries from the unit’s payroll and other legal sources.

Minister Tra explained that the draft law applies to civil servants employed under labor contracts in public service units, funded by the unit’s payroll and other lawful sources. Regarding policy implementation costs, she emphasized, “Salary and bonus policies based on job positions will continue under the current salary scale until the wage reform outlined in Resolution 27 of the Central Committee is implemented.”
Additionally, redesigning job positions for civil servants will not increase expenses initially, as post-law enactment, existing salary policies will remain in effect as per government regulations.
Highlighting key revisions, Minister Tra noted the law modernizes civil servant recruitment, management, and deployment based on job positions. “Recruitment, management, and deployment will be based on job requirements and performance, eliminating professional title upgrades,” she stated.
Recruitment methods will include competitive exams, open evaluations, and direct appointments for high-caliber candidates. Public service units can choose recruitment methods suited to their sector, fostering professional and modern governance. Transfers between units will follow standard procedures.
The draft expands civil servant rights, allowing them to sign contracts with other public or private entities, provided it doesn’t conflict with existing agreements or laws. This aims to leverage their expertise for societal contributions and increase legitimate income.
Civil servants in public science, technology, and higher education institutions can invest in, manage, or work for companies commercializing their research, with approval from leadership. Senior officials require higher-level approval.
The law encourages innovation, risk-taking, and accountability among civil servants for public benefit.
Minister Tra outlined three job categories in public service units: managerial positions (appointed leadership roles), specialized roles (meeting sector-specific standards), and support roles (finance, administration, etc.), excluding service positions like drivers or security.

Committee Chairman Hoang Thanh Tung supported position-based management, aligning with public sector reforms. This fulfills the Party Central Committee’s Conclusion 121, enabling position-based salaries and harmonizing with civil service laws.
“The government should ensure scientific and high-quality job position listings,” Tung urged.
The committee endorsed allowing civil servants to contract with other entities, provided it complies with existing agreements and laws. This maximizes their expertise for societal benefit and boosts income.
Civil servants in public science and education can work in affiliated companies commercializing research, aligning with Politburo Resolution 57 and innovation laws.
Regarding employment contracts, the committee advised clarifying unique provisions distinct from the Labor Code within the law, especially termination clauses, to protect constitutional labor rights.
