The Ring Road 1 project, spanning from Hoang Cau to Voi Phuc, covers approximately 2.2 kilometers with a total investment of over 7.2 trillion VND from the city’s budget. Approved in December 2017, the project was slated for completion by 2020. However, it remains unfinished due to challenges in land clearance.
Mr. Dang The Thap, residing at 351 De La Thanh, O Cho Dua Ward, is one of the households yet to hand over land for the project. He stated that while residents are willing to surrender their land, the current compensation plan is unfairly disadvantageous to them.
In Mr. Thap’s case, his family occupies 189.4 square meters at 351 De La Thanh, including a three-story house home to 10 family members. Of this, 128.4 square meters fall within the land clearance boundary, and 61 square meters lie outside it.

Under Decision No. 2063/QD-UBND issued by the former Dong Da District, the family was compensated over 3.1 billion VND without resettlement. Previously, Decision No. 2824 dated June 26, 2024, by the Dong Da District People’s Committee approved a compensation of only 147.6 million VND.
Mr. Thap argues that Decision No. 2063 fails to protect his family’s rights. From 1989 to 1993, his family received residential land from the Hoang Cau Agricultural Cooperative, paid for it at residential rates (with receipts and handover documents), and has lived there stably for decades. However, the compensation plan classifies this land as agricultural land without proper documentation, undervaluing it.
Additionally, his family of 10, divided into three households for decades, was not offered resettlement after losing 128 square meters.

Furthermore, Decision No. 2063, issued on May 29, 2025, failed to apply the new land price schedule despite the 2024 Land Law and updated city land prices being in effect.
Mr. Nguyen Manh Dung, Director of the Investment and Infrastructure Management Board of O Cho Dua Ward, reported that 591 land plots in the ward are affected by the Ring Road 1 project. Over 300 households have handed over their land, while more than 200 remain uncooperative.
Mr. Dung noted numerous complaints regarding compensation and resettlement. Local authorities have addressed these grievances as required. Since the two-tier government system began, over 100 households have surrendered their land. “We aim to complete land clearance by 2025,” Mr. Dung added.

Seeking Special Mechanisms to Expedite Land Clearance
Regarding Mr. Thap’s case, Mr. Dung explained that the compensation plan approved in June 2024 followed the 2013 Land Law and earlier regulations. Thus, Decision No. 2063 adheres to the old policies. New policies apply only to cases without approved plans or land recovery decisions.
On resettlement, Mr. Dung noted that the former ward police confirmed only four family members at the time of land clearance filing. Residents can petition the police for verification if they dispute this.

Mr. Dung added that households retaining viable land post-clearance are ineligible for resettlement. However, those facing severe living difficulties afterward may qualify. The ward is proposing a special mechanism: households with less than 40 square meters but seven or more members could receive one resettlement allotment. This proposal is under review by city departments.
Attorney Pham Thi Thu of the Hanoi Bar Association criticized the former Dong Da District’s compensation approach as non-compliant with the 2024 Land Law, specifically Article 94, Clause 5. Adjusted compensation plans must reflect current land and asset values, not those from initial approvals.
Attorney Thu also highlighted that Decision 2063 denies Mr. Thap’s family resettlement, despite the remaining 61 square meters being unsafe and unsuitable for new construction due to its agricultural classification and lack of a land title. The O Cho Dua Ward and Hanoi People’s Committee should revisit the compensation plan for Mr. Thap and similar cases to ensure legal compliance.
The Hanoi People’s Committee reported nearly 500 complaints related to the Ring Road 1 project’s land clearance. Local authorities have addressed these according to regulations.
During the 25th session on July 9, the Director of Hanoi’s Construction Department pledged to complete land clearance by 2025.
