The Central Military Procuracy has issued an indictment for the case of Violation of Land Management Regulations and Fraudulent Appropriation of Property, which occurred at Nha Trang Airport in Khanh Hoa province.

Accordingly, the Procuracy has charged several defendants, including Nguyen Chien Thang, Le Duc Vinh (both former Chairmen of Khanh Hoa Provincial People’s Committee), Dao Cong Thien, former Vice Chairman of Khanh Hoa Provincial People’s Committee, and Vo Tan Thai, former Director of Khanh Hoa Department of Natural Resources and Environment, with Violation of Land Management Regulations.
Former Major General Hoang Viet Quang, former Deputy Director of the Operations Department (Ministry of National Defense), and former Major General Nguyen Duy Cuong, former Principal of the Air Force Officer School, have also been charged with Violation of Land Management Regulations.
Defendants Nguyen Van Hau (aka Hau “Pháo”), former Chairman of Phuc Son Group Joint Stock Company; Nguyen Thi Hang, former Deputy General Director of Phuc Son Group; and Tran Van Dinh, Director of Nam A Investment Joint Stock Company, have been charged with Fraudulent Appropriation of Property.
According to the indictment, during the transfer of approximately 186 hectares of defense land at Nha Trang Airport to the Khanh Hoa Provincial People’s Committee, the defendants allegedly violated legal procedures and disregarded the Prime Minister’s directives and the consensus between the Ministry of National Defense and the provincial authorities. As a result, nearly 63 hectares of defense land were unlawfully transferred to Phuc Son Company, causing significant losses to the state in managing and utilizing defense land.

Subsequently, Hau signed over 980 contracts with 683 individuals, collecting more than 7 trillion VND. Approximately 6 trillion VND was recorded in the company’s books. Hau then directed his staff to legalize the sale of 211 land plots to Tran Van Dinh, who resold them to buyers at a markup to generate profits.
Additionally, Hau instructed Nguyen Thi Hang to keep over 1 trillion VND off the company’s books for personal use.
The indictment states that during the investigation, the Criminal Investigation Agency of the Ministry of National Defense seized and impounded assets belonging to Nguyen Van Hau and related individuals and companies. Notably, Nguyen Thi Hang requested to use 200 million VND from her frozen account and had her brother submit an additional 20 million VND to mitigate the damages caused by the case.
The Central Military Procuracy has also ordered the seizure of 1,422 land use right certificates registered under various organizations and individuals; a Mercedes S600 vehicle registered under Phuc Son Group Joint Stock Company; 501 pieces (taels) of gold metal (seized from Nguyen Van Hau); and 33 pieces (taels) of gold metal seized from Nguyen Thi Hang.
Furthermore, the prosecuting authority has ordered the seizure of all remaining funds belonging to Nguyen Van Hau after fulfilling his obligations under the first-instance judgment No. 466/2025 of the Hanoi People’s Court to ensure enforcement of the judgment.
During the proceedings, the procuracy noted Hau’s request to sell the 501 pieces (taels) of gold metal to pay 60 billion VND in damages. Consequently, the procuracy decided to return these assets to Hau. To date, Hau has deposited 60 billion VND into the enforcement agency’s account.
Additionally, the investigation agency has seized nearly 9 billion VND belonging to other defendants and individuals involved in the case.
The Central Military Procuracy has classified this case as particularly serious. The defendants failed to fulfill their responsibilities in recovering, transferring land, and awarding projects to investors. This enabled Nguyen Van Hau and his accomplices to exploit the situation by signing land transfer contracts, mobilizing capital unlawfully, and embezzling others’ property.
The root cause of these violations lies in the inconsistencies and overlaps within the legal framework governing land management and public asset management. These issues complicate the determination of authority and procedures for land allocation, recovery, and transfer to local governments.
The defendants, holding positions of authority related to land and public asset management, failed to thoroughly understand and adhere to legal regulations, leading to violations that wasted resources and hindered Khanh Hoa province’s economic and social development opportunities.
Moreover, state management agencies in Khanh Hoa province have been lax in regulating the real estate market, allowing businesses to market properties without meeting legal requirements or obtaining necessary permits.
