Proposed Annual Income Increase of 1 Billion VND Requires Asset Origin Disclosure

The proposed legislation aims to raise the threshold for declaring additional assets and income from 300 million VND to 1 billion VND, applicable when there is an increase in value during the year.

On the morning of November 4th, during the 10th Session, Inspector General Doan Hong Phong presented the draft Law amending and supplementing certain provisions of the Anti-Corruption Law.

One of the new regulations is to increase the value of assets and income subject to declaration, as well as the threshold for additional declarations of asset and income fluctuations within the year.

The draft law specifies the following agencies responsible for asset and income control: Inspection Committees at the provincial level and above; Government Inspectorate; Supreme People’s Court, Supreme People’s Procuracy, State Audit Office, National Assembly Office, Presidential Office, National Assembly’s Committee on Deputies, central bodies of socio-political organizations; Ministries, ministerial-level agencies, government agencies; Provincial and municipal Inspectorates.

The draft law raises the asset declaration threshold from 50 million VND to 150 million VND and increases the threshold for additional declarations of asset and income fluctuations within the year from 300 million VND to 1 billion VND.

This adjustment aligns with the current socio-economic development and rising prices compared to 2018.

Inspector General Doan Hong Phong presents the draft Law amending and supplementing certain provisions of the Anti-Corruption Law.

According to the draft law, asset and income control agencies monitor fluctuations in assets and income of declarants through analysis and evaluation of information from declarations or other sources.

If an asset or income fluctuation of 1 billion VND or more is detected within the year and the declarant fails to declare it, the asset and income control agency will request the individual to provide additional information. In cases of increased assets or income, the declarant must explain the source of the additional assets or income.

If the explanation for the source of assets or income increasing by 1 billion VND or more is deemed unreasonable, the asset and income control agency will conduct a verification.

The draft law also adds a provision stating that “asset and income declarations, as well as explanations of the sources of additional assets and income, are criteria for evaluating the performance of officials, Party members, civil servants, and public employees.”

During the review of the draft law, Chairman of the Committee on Legal and Judicial Affairs Hoang Thanh Tung stated that point b, clause 1, Article 35 (amended) specifies the value of assets and income subject to declaration as follows: “Precious metals, gemstones, cash, valuable papers, and other assets with a value of 150 million VND or more per asset type.”

Clause 2, Article 36 (amended) specifies the threshold for additional declarations of asset and income fluctuations within the year as follows: “Additional declarations are required when the declarant experiences asset or income fluctuations within the year with a value of 1 billion VND or more.”

Hoang Thanh Tung expressed general agreement with the draft law’s provisions on increasing the asset and income declaration thresholds and the thresholds for additional declarations of asset and income fluctuations within the year.

These regulations reduce unnecessary administrative procedures for controlling declarations of small-value assets and income, thereby enhancing corruption prevention efforts.
