Land Management Scandal: Former Commune Officials Sentenced for Misconduct

The People's Court of Zone 4 in Khanh Hoa has sentenced Nguyen Thanh Nam, former Chairman of Van Thanh Commune People's Committee, along with five other ex-officials, for violations in land management and the issuance of land use right certificates.

On November 4th, the People’s Court of Zone 4 in Khanh Hoa Province sentenced six former officials for land management violations in Van Thanh Commune, formerly part of Van Ninh District (now Dai Lanh Commune, Khanh Hoa Province).

The court sentenced Nguyen Thanh Nam, former Chairman of Van Thanh Commune People’s Committee, to 8 years in prison. Tran Cong Danh, former land administration officer of Van Thanh Commune, received 6 years and 6 months for “Abusing Power and Position While Performing Public Duties.”

Le Hoang Vuong, former Vice Chairman of Van Thanh Commune; Lam Tuan Anh, former Director of the Land Registration Office Branch in Van Ninh District; and Vo Thanh Son, former Head of the Department of Natural Resources and Environment in Van Ninh District, each received 4 years for “Negligence Causing Serious Consequences.”

Nguyen Quoc Duy, former team leader at the Land Registration Office Branch in Van Ninh District, received a 3-year suspended sentence for the same charge.

The court also annulled all land use certificates issued unlawfully for five plots of land by the defendants.

According to the case details, the defendants violated regulations in preparing, verifying, and approving land use certificates for five plots, resulting in the state losing management rights over land valued at over 2.8 billion VND at the time of certification.

Specifically, from 2016 to 2018, Nguyen Thanh Nam, as Chairman of Van Thanh Commune, directed Tran Cong Danh to improperly issue land use certificates for four plots, causing losses exceeding 2.7 billion VND.

Nam also directly requested the Van Ninh District Land Registration Office to survey and sign documents for two plots under the name Nguyen Thanh Quang. After obtaining the certificates, Nam brokered the sale of these plots, profiting over 6 billion VND unlawfully.

Tran Cong Danh prepared files without verifying land status or origins. Defendants Vuong, Duy, Tuan Anh, and Son were negligent in their verification and approval processes, leading to unlawful land certifications.

The court determined that the land certification files violated legal regulations. All plots were under the management of the former Van Thanh Commune People’s Committee.

The initial land use certificates for the five plots, based on the defendants’ criminal actions, were deemed invalid and without legal standing.

The court annulled the initial land certificates and all subsequent derivative certificates, ordering current land managers to return the land and assets to the Dai Lanh Commune People’s Committee. Over 1.6 billion VND voluntarily submitted by the defendants during investigations was confiscated for the state treasury.
