In the latest draft of the Decree on Administrative Penalties for Construction Violations, the Ministry of Construction has proposed new regulations to penalize violations related to real estate business activities.

New Penalties Proposed for Real Estate Business Violations in Vietnam

Real estate businesses failing to meet requirements may face fines up to VND 200 million.

According to the draft decree, a fine of VND 120-160 million will be imposed for conducting real estate business without establishing a company, cooperative, or cooperative union as required by law.

A fine of VND 160-200 million applies to businesses operating without meeting the mandated conditions.

Additional penalties include a 3-6 month suspension of real estate operations from the effective date of the administrative penalty decision.

The draft also proposes a VND 240-300 million fine for developers or real estate service providers accepting payments outside designated bank accounts. Non-compliant transactions must be redirected to approved accounts.

Fines of VND 300-400 million target businesses failing to disclose accurate project information before sales commencement or not updating changes as required.

Violations in selling developed land or properties with technical infrastructure incur VND 400-500 million fines.

Improper collection of real estate-related fees results in VND 500-600 million penalties.

Non-disclosure of mortgage information for existing properties carries VND 600-800 million fines.

Selling incomplete properties leads to VND 800 million – 1 billion fines, suspension, and refund mandates.

Future project violations attract VND 260-300 million fines for lacking bank guarantees or proper documentation.

Mismanagement of deposits or funds for future projects results in VND 600-800 million fines, profit forfeiture, and refund obligations.

Non-disclosure of future project mortgages incurs VND 600-800 million fines and refund requirements.

Selling unauthorized future projects leads to VND 800 million – 1 billion fines.

Land transfer violations without proper oversight result in VND 120-180 million fines.

Non-disclosure of land mortgages carries VND 600-800 million penalties.

Premature land transfers incur VND 800 million – 1 billion fines, profit forfeiture, and refund mandates.

Unauthorized project transfers face VND 600-800 million fines.

Improper project transfers result in VND 800 million – 1 billion fines.

Contract violations attract VND 180-260 million fines for non-compliant agreements.

Specific violations regarding land-attached sales incur VND 260-300 million fines.

Price regulation breaches result in VND 300-500 million penalties.

Unauthorized contract transfers lead to VND 800 million – 1 billion fines.

Certificate processing delays incur fines based on duration and scale: 30-50 million (under 50 units), 50-80 million (50-200 units), 80-160 million (over 200 units) for 50-180 days; escalating to 500 million – 1 billion for over a year.

The Ministry of Construction is seeking public feedback on this draft via its official portal.
