Minister of Construction Tran Hong Minh stated that the draft law aims to streamline procedures, ensuring that construction management authorities conduct a single administrative check per project from preparation to groundbreaking.
Projects with feasibility studies approved by construction specialists are exempt from obtaining a construction permit.
According to Minister Tran Hong Minh, the draft law simplifies conditions, procedures, and timelines for construction permits, mandates full online processing, and aims to reduce permit issuance time to a maximum of 7 days.
The draft law stipulates that before commencing construction, investors must obtain a permit, except for specific cases outlined in the law. These exceptions include Level IV constructions and rural single-family homes under 7 stories, provided they align with general planning and lack architectural management regulations or detailed planning requirements under urban and rural planning laws.
Presenting the review report, Nguyen Thanh Hai, Chair of the National Assembly’s Committee on Science, Technology, and Environment, noted that permits are not barriers but tools to protect societal order and interests. The focus should be on improving permit quality and processes.
The Committee recommends streamlining procedures, clarifying responsibilities and timelines, and ensuring public transparency for citizen and business oversight.
Additionally, the Committee suggests that while exempting permits reduces bureaucracy, legal provisions in the Construction Law or Land Law must be enhanced to safeguard property rights.
The review body also proposes adding mechanisms to address violations in permitted projects that deviate from designs, change functions, or breach regulations, ensuring clear accountability among stakeholders.

Under current regulations, competent authorities must issue construction permits within 20 days of receiving complete applications for construction projects, including temporary, adjusted, and relocation permits, and within 15 days for single-family homes. |
