Heavy Fines of Up to 160 Million VND for Selling or Renting Social Housing to Ineligible Individuals

The Ministry of Construction is drafting a Decree outlining administrative penalties for construction violations. Within this draft, the Ministry proposes addressing breaches related to the management of residential property transactions.

Selling, leasing, or lease-purchasing social housing to ineligible individuals or entities will result in fines ranging from 120 to 160 million VND.

According to the draft, fines ranging from 60 to 80 million VND will be imposed for any of the following violations:

Leasing dormitory housing for workers in industrial zones to ineligible individuals or entities.

Leasing dormitory housing for workers in industrial zones without complying with the stipulated conditions (except as noted above).

Leasing dormitory housing for workers in industrial zones without adhering to the price framework set by the Provincial People’s Committee.

Leasing dormitory housing for workers in industrial zones without drafting a rental contract as required.

Tenants or lease-purchasers of social housing who fail to use the property for their own residence or that of their family members may face fines of up to 120 million VND.

Additionally, fines ranging from 80 to 120 million VND will be imposed for any of the following violations:

Tenants or lease-purchasers of social housing who fail to use the property for their own residence or that of their family members during the rental or lease-purchase period.

Buyers or lease-purchasers of social housing who resell the property in violation of regulations.

Collecting advance payments from social housing buyers in violation of regulations.

Tenants of dormitory housing for workers in industrial zones who sublease or transfer rental contracts in violation of regulations.

Fines ranging from 120 to 160 million VND will be imposed for any of the following violations:

Selling, leasing, or lease-purchasing public property without proper authority, to ineligible individuals or entities, or without meeting the stipulated conditions.

Selling, leasing, or lease-purchasing social housing to ineligible individuals or entities.

Selling, leasing, or lease-purchasing social housing without complying with the stipulated conditions.

Furthermore, fines ranging from 200 to 260 million VND will be imposed on developers of social housing projects who transfer land use rights to individuals for self-construction of housing.

Fines ranging from 260 to 280 million VND will be imposed on developers of social housing projects for any of the following violations:

Constructing commercial service facilities, commercial housing, or exceeding 20% of the total residential land area or 20% of the total residential floor area as stipulated.

Failing to allocate or insufficiently allocating land area for social housing construction within projects that have invested in technical infrastructure, as required for commercial housing or urban area projects. This violation will also result in corrective measures, including requiring developers to allocate a portion of the land area within the project for social housing construction or arrange for social housing land funds with invested technical infrastructure in another location outside the commercial housing project in the same urban area, or pay an equivalent amount for the land fund with invested technical infrastructure for social housing construction as stipulated.

According to the draft, fines ranging from 280 to 300 million VND will be imposed on developers, sellers, or donors of housing to foreign organizations or individuals for any of the following violations:

Selling, lease-purchasing, or donating housing to ineligible foreign individuals or organizations not permitted to own housing in Vietnam.

Selling, lease-purchasing, or donating housing in excess of the stipulated quantity.

Failing to submit or delaying the submission of notifications (via email and in writing) regarding the buyer’s name and address of the sold, lease-purchased, or donated housing to the provincial housing management authority as required.
