Clause 2, Article 7 of Decree No. 123/2015/NĐ-CP dated 15/11/2015 by the Government outlines the conditions for changing or correcting household registration:

2. Correcting household registration, as per the Household Registration Law, involves amending personal information in the Household Registration Book or the original household registration documents. This is only permissible when there is sufficient evidence of an error made by the household registration officer or the applicant.

This clause is further guided by Clauses 1 and 2 of Article 17 in Circular No. 04/2020/TT-BTP:

Article 17. Correcting household registration

1. Corrections to household registration are only processed after confirming an error in the registration. Corrections are not made to legitimize information on other personal documents or records.

2. Errors in household registration may stem from the applicant or the registering authority.

Article 28 of the 2014 Household Registration Law details the procedure for changing or correcting household registration:

Article 28. Procedure for changing or correcting household registration

1. The applicant must submit a declaration form and relevant documents to the household registration authority.

2. Within 3 working days of receiving the required documents, if the request for change or correction is deemed valid and compliant with civil and related laws, the judicial officer will update the Household Registration Book. The applicant and officer will sign the book, and the officer will issue an excerpt to the applicant.

For changes or corrections related to Birth Certificates or Marriage Certificates, the officer will update these documents accordingly.

If verification is needed, the process may be extended by up to 3 working days.

3. If the change or correction is not requested at the original registration location, the local People’s Committee must notify the original registration authority in writing, accompanied by a copy of the excerpt.
