Compulsory Land Acquisition for the An Binh Tan Project in Nam Nha Trang Ward, Khanh Hoa Province

On the morning of November 11th, the Nam Nha Trang Ward in Khanh Hoa Province executed a land reclamation order in the An Binh Tan urban area.

The People’s Committee of Nam Nha Trang Ward, Khanh Hoa Province, has announced that from November 6 to November 11, the local authorities will forcibly reclaim land from cases within the area designated for the social housing project in the An Binh Tan Urban Area, covering approximately 6.5 hectares.

Swift Enforcement

According to the announcement, the People’s Committee requires residents to harvest aquaculture products and cease new releases in the area of the An Binh Tan project. They must also dismantle unauthorized structures and parking lots. The committee will enforce land reclamation for several households in the Dong Muoi II area (Phuoc Thanh residential area, Nam Nha Trang Ward).

Simultaneously, the ward has established an Enforcement Board, approved an organizational plan, and arranged security forces to maintain order during the enforcement process.

Authorities enforcing land reclamation on November 11

Previously, on October 22, 2025, the People’s Committee of Khanh Hoa Province issued Decision No. 1738/QD-UBND, approving the joint venture between Construction and Technical Material Supply Corporation and MK Investment Construction Joint Stock Company as the investor for the CT-02 Social Housing Project. The project spans over 2 hectares, with a total investment of nearly 1,645 billion VND, comprising 4 residential buildings, each 15 stories high, providing 936 social housing units.

Just over 20 days later, the People’s Committee of Nam Nha Trang Ward initiated land reclamation to facilitate this project.

For years, this land could not be reclaimed due to some households’ disagreement with the compensation, support, and resettlement plans approved by competent authorities. The newspaper *Nguoi Lao Dong* has extensively covered this project.

Now, local authorities are enforcing reclamation to ensure the timely implementation of social housing projects within the An Binh Tan Urban Area.

The People’s Committee of Nam Nha Trang Ward stated that the enforcement is conducted in accordance with legal procedures and within their jurisdiction. The goal is to clear the land for social housing projects and complete the technical infrastructure connectivity for the entire An Binh Tan Urban Area.

Why the Lawsuit?

According to the People’s Committee of Nam Nha Trang Ward, the land reclamation enforcement is based on legal documents, including: Announcement No. 376/TB-UBND dated August 23, 2023, from the Chairman of the People’s Committee of Khanh Hoa Province regarding the conclusion of a meeting on the An Binh Tan project land reclamation report; Official Letter No. 1144/UBND-XDNĐ dated July 29, 2025, concerning compensation and site clearance; and various decisions, announcements, and conclusions related to land reclamation for this project since 2010.

The ward has also issued enforcement decisions and approved enforcement plans, including Decision No. 2128/QD-UBND dated October 28, 2025, approving the land reclamation enforcement plan to ensure security and order for the technical infrastructure construction of the social housing project in the An Binh Tan Urban Area.

Lawsuit filed by residents

However, some households in the Dong Muoi II area disagree, claiming that the enforcement lacks sufficient legal basis.

Mr. Nguyen Van Bon, one of the affected households, filed a lawsuit with the People’s Court of Zone I, Khanh Hoa Province, requesting the annulment of Decision No. 2128/QD-UBND on land reclamation enforcement by the People’s Committee of Nam Nha Trang Ward.

In his lawsuit, Mr. Bon argues that his family has not received compensation, support, or resettlement as required by law. He contends that the approved compensation plan does not ensure the legal rights of those whose land is being reclaimed. He also mentions that previous complaints to relevant authorities have not been resolved.

Regarding this project, previous inspection reports have highlighted issues in its implementation. Inspection Conclusion No. 03/KL-TTT dated September 14, 2025, by the Inspection Commission of Khanh Hoa Province identified violations in issuing enforcement decisions and applying legal grounds for the An Binh Tan project.

Earlier, Conclusion No. 1989/KL-TTCP dated January 30, 2011, by the Government Inspectorate also identified violations in compensation and site clearance for this project.
