Encroachment on Hanoi Lakes: Local Wards and Communes Fail to Implement Violation Handling Directives

Despite the Hanoi People's Committee's mandate to resolve all 220 outstanding violations related to irrigation canals and lakes by October 30, 2025, no commune has yet reported back to the Hanoi Department of Agriculture and Environment. Meanwhile, new violations continue to emerge.

A report by Tiền Phong journalists at the site of land encroachment on Cố Đụng Lake (Yên Xuân Commune) reveals that the area has been ordered to be cleared. However, the adjacent encroached land has been fenced off and planted with trees. A shipping container, presumably to “reserve” the land, remains on-site.

Speaking to reporters at the scene, representatives from Sông Tích Irrigation One-Member LLC stated that upon discovering the violation, they demanded the offender remove all dumped soil from the lake and refrain from repeating the offense.

Regarding the fenced area with the container, Yên Xuân Commune issued an administrative penalty decision on August 14, 2025. The offender, however, has neither complied nor remedied the situation. On October 14, 2025, they filed an appeal against the penalty. The Commune People’s Committee is currently processing the appeal and will proceed with legal actions once a resolution is reached.

According to Sông Tích Irrigation One-Member LLC, two additional structures violate regulations by being built directly on the lake’s dam. Since the land was originally red-booked under Hòa Bình Province, the company inspects and documents violations during construction but has been unable to enforce permanent solutions.

A representative from Hanoi’s Irrigation and Disaster Prevention Agency (under the Department of Agriculture and Environment) noted that in late September 2025, Hanoi People’s Committee issued Directive 5316 to intensify enforcement against violations within irrigation protection zones.

The directive mandates that commune and ward authorities resolve 220 outstanding 2025 violations by October 30, 2025, particularly those repeatedly urged by the Department of Agriculture and Environment. “To date, no commune or ward has submitted enforcement reports,” the agency representative stated.

They added that by December 10, the agency plans to request Hanoi People’s Committee impose sanctions on communes/wards identified as hotspots for irrigation violations.

The Department of Agriculture and Environment’s report indicates 261 irrigation violations in Hanoi since 2025’s start, with 5 new cases in September 2025.

Notable recent violations include Đinh Phú Cường’s installation of iron pillars and a metal platform within Đồng Đò Lake’s protected area in Kim Anh Commune, managed by Hanoi Irrigation Development LLC. Another case involves VINADIC Company, which demolished canal banks and dumped soil into Cầu Ngà Canal’s protected area (200 m²) in Xuân Phương Ward, managed by Sông Nhuệ Irrigation Development LLC.

On September 19, Hanoi’s Chairman issued Directive 15/CT-UBND to strengthen prevention and enforcement against irrigation zone violations. It requires irrigation operators to inspect, detect, and collaborate with local authorities for swift action. Commune/ward chairs are accountable for delays, with violations addressed via the “4 Clears” principle: clear offender, action, responsibility, and outcome.
