Crackdown on Illegal Ticket Scalping: Fines Up to 4 Million VND for Unlawful Train Ticket Sales

Accordingly, a fine of 10 to 20 million VND is imposed on railway transport businesses and railway infrastructure management companies that commit any of the following violations:

Railway transport businesses fail to appoint a person in charge of the traffic safety technical department or the railway transport operation management department, or the appointed person does not meet the required conditions.

Railway infrastructure management companies fail to appoint a person in charge of the railway traffic operation technical department or the company manager, or the appointed person does not meet the required conditions.

A fine of 20 to 30 million VND is imposed on railway transport businesses and railway infrastructure management companies that commit any of the following violations:

Railway transport businesses do not have a traffic safety technical department or a railway transport operation management department as required.

Railway infrastructure management companies do not have a railway traffic operation technical department, a safety department, or a railway infrastructure asset management department as required.

Transporting live animals improperly can result in a fine of up to 5 million VND

The draft clearly states that a fine of 3 to 5 million VND is imposed on railway transport businesses that commit any of the following violations:

Transporting human remains or ashes in violation of regulations.

Transporting live animals improperly.

Failing to publish, announce, or disclose on mass media or the company’s website, or publishing incorrectly, information about: train schedules, passenger transport prices, luggage transport prices, cargo transport prices, other fees, ticket sales plans, lists of prohibited goods on passenger trains, and company regulations on passenger service responsibilities.

Failing to notify passengers of remaining seats for trains using electronic ticketing systems as required.

A fine of 5 to 10 million VND is imposed on railway transport businesses that fail to provide discounts or apply discounts incorrectly.

A fine of 10 to 20 million VND is imposed on railway transport businesses that commit any of the following violations:

Failing to perform special transport duties or social welfare tasks as requested by the head of the competent state management agency in accordance with the law.

Failing to comply with regulations on transporting oversized or overweight cargo.

Failing to comply with regulations on loading, unloading, and transporting hazardous goods.

Failing to ensure minimum living conditions for passengers in case of transport interruptions due to traffic accidents, natural disasters, or enemy actions.

Failing to comply with regulations on cargo loading and securing on train cars.

Failing to assign sufficient staff on trains as required.

Failing to establish work procedures for train staff as required.

Using counterfeit train tickets can result in a fine of up to 200,000 VND

According to the draft, a warning or a fine of 100,000 to 200,000 VND is imposed for using counterfeit train tickets.

A fine of 2 to 4 million VND is imposed on individuals who commit any of the following violations: station ticket sellers, ticket agency sellers, or on-board ticket sellers selling tickets improperly; buying or selling tickets for illegal profit.

A fine of 10 to 15 million VND for individuals, or 20 to 30 million VND for organizations, is imposed for committing any of the following violations: transporting, selling, or storing counterfeit train tickets.

The Ministry of Construction is seeking feedback on this draft via its official electronic information portal.
