Exposing the Tactics of Housing Brokers: How ‘Cò’ Manipulate and Inflate Social Housing Prices

To enhance transparency and streamline the approval and management of social housing projects, the Ministry of Construction has mandated that provincial People’s Committees take the lead or collaborate with relevant agencies to conduct inspections, oversight, and enforcement actions against violations in the investment, construction, and sale of social housing units.

A citizen, T.T.B., has raised concerns with the Ministry of Construction regarding the current social housing policy and its implementation. They highlight issues in projects like the one in Thanh Hoa, where there are cases of applicants without genuine housing needs. These applicants allegedly use connections to secure spots, intending to resell them at a premium.

According to the citizen, housing brokers are inflating prices significantly above the original cost. This distortion of the support policy makes it difficult for those with genuine needs to access social housing.

To address this, the citizen suggests stricter scrutiny of application files, severe penalties for speculation and price gouging, and a transparent mechanism to ensure those with real needs can access social housing.

In response, the Department of Housing and Real Estate Market Management (Ministry of Construction) stated that Clause 15, Article 75 of Decree No. 100/2024 details the responsibilities of provincial People’s Committees. This aims to enhance transparency in the management and allocation of social housing, ensuring low-income workers with genuine needs can access it.

Provincial People’s Committees are tasked with inspecting, supervising, and addressing violations related to the investment, construction, sale, lease, and lease-to-own of social housing, military housing, and worker dormitories within their jurisdictions.

Additionally, Clause 2, Article 38 of Decree No. 100/2024 mandates that representatives from the local Department of Construction oversee the lottery process for social housing purchases and lease-to-owns. A record of the lottery results must be maintained.

Regarding social housing management and use, the Ministry of Construction has proposed new penalties in a draft decree. Individuals who purchase or lease-to-own social housing and then rent it out without residing there may face fines of 80-120 million VND. This is a new provision compared to current regulations.

Similar penalties apply to those who illegally sell, rent, or transfer social housing. The fine has increased from the current 40-120 million VND under Decree 16/2022.

Prime Minister Directs Ministry of Public Security to Strictly Address Social Housing Violations

At the 3rd meeting of the Central Steering Committee on Housing Policy and Real Estate Market on November 11, Prime Minister Pham Minh Chinh highlighted that some localities have not adequately vetted social housing applicants, leading to corruption and public outrage.

The Prime Minister emphasized the need for transparency and urged relevant ministries and localities to tighten control. He specifically instructed the Ministry of Public Security to investigate and penalize violators, preventing the distortion of this humane policy by the Party and State.
