Steep Fines of Up to 20 Million VND for Unreported Rooftop Solar Installations

The Ministry of Industry and Trade has proposed fines ranging from 500,000 to 3 million VND for individuals or entities installing self-generated and self-consumed power systems under 100kW that are connected to the national grid without proper reporting. For projects with a capacity of 100kW or higher, penalties can escalate up to 20 million VND.

The newly drafted Decree on administrative penalties in the field of electricity and efficient energy use, currently under review by the Ministry of Industry and Trade, includes several notable provisions.

Specifically, the Ministry proposes that for self-generating and self-consuming power projects connected to the national grid with a capacity below 100 kW, failure to submit the required notification or non-compliance will result in a warning.

If the violation persists within 10 days of the initial penalty, individuals or organizations will face fines ranging from 500,000 to 1 million VND for systems under 20 kW, and 2 to 3 million VND for systems between 20 kW and 100 kW.

For projects with a capacity of 100 kW or higher, stricter penalties apply, with fines ranging from 10 to 20 million VND. This includes violations such as failing to submit development notifications, operating without a registration certificate, not coordinating with power companies for technical connections, non-compliance with authority requests, unauthorized electricity sales, and disregarding dispatch orders, which may compromise safety.

Roof-based solar power projects with a capacity of 100 kW or more that are self-generating and self-consuming, if connected to the national grid without notification, will incur fines between 20 and 30 million VND.

Notably, failure to dismantle wind or solar power plants as required by authorities, or deliberate delays in doing so, can result in fines of up to 80-100 million VND.

In addition to monetary penalties, the Ministry of Industry and Trade suggests implementing corrective measures with a “maximum deterrent effect,” including mandatory dismantling of wind and roof-based solar power plants for severe violations, and enforcing compliance with approved investment conditions.

Previously, in the draft amendments to Decree 57/2025, which governs direct electricity sales between renewable energy generators and large consumers, and Decree 58/2025 on renewable energy development, the Ministry proposed adjustments to the procedures for residential solar panel installations.

For systems not connected to the national grid, individuals and organizations need only notify the local commune-level People’s Committee.

For systems connected to the national grid (even if only for self-consumption without selling excess electricity), notifications must be submitted through the commune-level People’s Committee, which then forwards them to the power company for monitoring and dispatch coordination as needed.
