Hanoi: Voters Propose Relaxing Land Subdivision Regulations

Voters believe that the current land subdivision conditions outlined in Decision No. 61/2024/QĐ-UBND dated September 27, 2024, issued by the City People’s Committee, are overly stringent. They urge the city to review and adjust these regulations to facilitate easier land subdivision for the public.

The Hanoi People’s Committee has recently addressed voter proposals regarding the reduction of minimum land area requirements for land subdivision.

Voters argued that the conditions for land subdivision, as outlined in Decision No. 61/2024/QĐ-UBND dated September 27, 2024, by the City People’s Committee, are overly stringent and impractical, particularly in rural areas. They urged the committee to reconsider and adjust the land subdivision regulations accordingly.

In response, the Hanoi People’s Committee clarified that land allocation limits and subdivision conditions for residential land plots must adhere to the principles and requirements stipulated in Article 220 of the Land Law, along with the following conditions: “Subdivided land plots must have a minimum area of 50m², a frontage width of at least 4m, and if an alleyway is included, the cross-sectional width must be at least 3.5m for wards and towns.”

Voters petition the city to revise land subdivision regulations

The Department of Agriculture and Rural Development has advised and reported to the People’s Committee on this matter, basing their decision on the previous Decision No. 20/2017/QĐ-UBND dated June 1, 2017, and adjusting the conditions related to plot dimensions and minimum subdividable area.

According to the National Housing Development Strategy for 2021-2030 approved by the Prime Minister, the target is to achieve an average housing area of approximately 27m² per person nationwide by 2025. This includes 28m² per person in urban areas and 26m² per person in rural areas.

By 2030, the goal is to increase the average housing area to around 30m² per person nationwide, with urban areas reaching 32m² per person and rural areas attaining 28m² per person.

Currently, Da Nang has set a minimum requirement of 50m², while Ho Chi Minh City mandates 36m² for core districts and 50m² for other districts.

To ensure minimum living standards, prevent unauthorized construction that increases floor area and fire risks, the Hanoi People’s Committee has raised the minimum land area for subdivision compared to previous regulations.

The committee believes that increasing the minimum land area for resettlement to 50m² will better benefit those whose land is acquired for resettlement purposes. This adjustment also aims to curb population growth in inner-city areas and alleviate pressure on technical infrastructure and social amenities.
