Four New Residential Projects in Ho Chi Minh City Receive Land Ownership Certificates

No Financial Obligations Incurred

Mr. Nguyen Toan Thang, Director of the Department of Agriculture and Environment of Ho Chi Minh City, recently chaired a meeting of Task Force 1645 to address and resolve issues related to the issuance of land use rights certificates and property ownership certificates (red books, pink books) for four housing projects.

The garden villa area in Hiep Binh Ward, developed by Viet Quoc Construction and Decoration Co., Ltd., comprises 241 villas. Certificates have already been issued for 223 units to homebuyers.

Cluster B apartments of the Saigon Intela project have been granted pink books.

The project’s land was reclaimed by the Prime Minister and leased to Viet Quoc Construction and Decoration Co., Ltd. for 103,105 square meters to develop and operate a garden villa complex under Decision No. 162/QĐ-TTg dated March 17, 1998.

Viet Quoc Construction and Decoration Co., Ltd. collaborated with contractors, builders, and design consultants to prepare completion inspection reports for each villa in the project. These reports concluded the approval of construction completion for handover and use.

According to Official Letter No. 10777/CCT-NVDT dated August 13, 2015, the Thu Duc District Tax Department confirmed that Viet Quoc Construction and Decoration Co., Ltd. has fulfilled its land tax obligations for the aforementioned land and has no outstanding land rental debts.

The developer has submitted nine applications for land use rights certificates for homebuyers in the project. Following input from task force members, Mr. Nguyen Toan Thang approved the issuance of certificates for these cases.

Cluster B of the Saigon Intela project in Binh Hung Commune, developed by Bac Phuoc Kien JSC, covers 9,016 square meters and includes 1,068 apartments and 34 commercial units. On December 3, 2009, Intresco transferred land use rights to Quoc Cuong Gia Lai JSC, which was duly recorded in the land use rights certificate.

After acquiring the land use rights, Quoc Cuong Gia Lai JSC transferred a 29,578 square meter plot (including Cluster B) to Sai Gon Xanh Real Estate Development JSC. The Department of Natural Resources and Environment issued Land Use Rights Certificate No. CT00029 to Sai Gon Xanh Real Estate Development JSC.

Sai Gon Xanh Real Estate Development JSC contributed the land use rights for Cluster B to Gach Do LLC, forming Quoc Cuong Sai Gon LLC. Quoc Cuong Sai Gon LLC was later renamed Bac Phuoc Kien JSC.

Cluster B, with a land area of 9,016 square meters, is part of the 29,578 square meter plot within the 13E South Residential Area project. The land use was re-planned from 29,344 square meters for apartment construction to 19,068 square meters for villas and 9,016 square meters for apartments.

Regarding this land use adjustment, the Department of Natural Resources and Environment issued Official Letter No. 3111/STNMT-KTĐ, reporting to the Ho Chi Minh City People’s Committee that no additional financial obligations arose. The project paid land use fees in 2008, calculated based on land price tables rather than planning indicators.

The developer stated that the project is scheduled for completion by the end of 2024. The management board has recently been established and is in the process of handing over maintenance funds. The Department of Construction requested the developer to clarify its social housing obligations and agreed to issue certificates to homebuyers while retaining commercial units. Mr. Nguyen Toan Thang concluded by approving the issuance of certificates to homebuyers.

Awaiting Ho Chi Minh City People’s Committee’s Decision

The 12-story apartment building in the 10-hectare resettlement area of Dong Hung Thuan Ward, developed by the District 12 Construction Investment Management Board, includes 320 apartments. The building has been inspected and approved for use by relevant authorities.

Previously, the District 12 Land Registration Office and the District 12 Department of Natural Resources and Environment (now Dong Hung Thuan Ward) handled applications for land use rights certificates for homebuyers. Currently, homebuyers are submitting applications to the Ho Chi Minh City Land Registration Office for the remaining apartments.

Opal Riverside apartments in Hiep Binh Ward have not been issued certificates due to unresolved financial obligations for over 4,900 square meters of canal and road land.

According to Mr. Nguyen Toan Thang, this is a resettlement project with 21 applications submitted to the Ho Chi Minh City Land Registration Office. While internal survey maps are typically required, priority is given to issuing certificates to resettled residents.

Opal Riverside in Hiep Binh Ward, developed by Dat Xanh Group JSC, covers over 10,000 square meters and includes 626 apartments. On November 27, 2017, the Department of Construction approved the completion inspection reports for Blocks A and B of Opal Riverside. On September 23, 2015, the Thu Duc District Tax Department and the Ho Chi Minh City Tax Department confirmed the developer’s financial obligations for the project.

However, a review revealed that over 4,900 square meters of canal and road land have unresolved financial obligations. The developer has requested to fulfill these obligations to enable the issuance of certificates to homebuyers.

Mr. Nguyen Toan Thang directed the Land Economy Department to report to the Ho Chi Minh City People’s Committee for a meeting to address this issue. He also required the developer to commit to fulfilling additional financial obligations to facilitate the issuance of certificates to homebuyers.

The Ben Luc Residential Area project in Binh Dong Ward, developed by Phu My Loi Construction JSC, includes 277 houses. Of these, 170 are designated for resettlement, and 107 are for commercial sale. Certificates have been issued for 58 houses.

The developer requested the issuance of pink books for 13 commercially sold houses that have already received red books. After considering input from meeting participants and the developer’s presentation, Mr. Nguyen Toan Thang approved the issuance of certificates as requested.
