Huế Construction Department Addresses Social Housing Complex Violating Setback Regulations

The Aranya social housing project has been found to violate building setback regulations, and the authority to issue "red books" (land use rights certificates) to residents does not fall under the jurisdiction of the Hue Department of Construction.

On November 20, the Hue Department of Construction issued an official response to Báo Người Lao Động regarding the violations of the red line boundary by the developer of the Aranya Social Housing Project. The project, located at CHC1 lot in Zone A of the An Vân Dương New Urban Area, Vỹ Dạ Ward (Hue City), has impacted the issuance of land use right certificates (red books) for residents.

According to the Department, the project was initially granted a construction permit on July 29, 2014, for four apartment blocks: CT1, CT2, CT3, and CT4. In the adjusted permit issued on May 20, 2020, blocks CT3 and CT4 were merged into a single block, CT3, with revised setback distances: 6.67 meters from the northern planned road, 3.2 meters from the western planned road, and 8.25 meters from the eastern planned road.

Several apartments facing the northern planned road are being denied red books due to violations of the setback distance.

The Department confirmed that measurements by the Hue Land Registration Office revealed discrepancies in the actual construction setbacks from the northern planned road compared to the issued permit. However, these discrepancies do not affect the red line boundaries of the surrounding roads.

For the remaining planned roads, the actual construction complies with the building boundaries outlined in the Zone A Master Plan of the An Vân Dương New Urban Area. The violations in setback distances do not impact the structural integrity of the buildings or the approved master plan.

The current construction status does not violate building boundaries, thus no adjustments are required. Residents have not received their red books due to the discrepancies in setback distances, which fall under land law regulations and are outside the jurisdiction of the Hue Department of Construction.

As previously reported by Báo Người Lao Động, the Hue Land Registration Office recently rejected red book applications for several CT3 apartments due to violations of the setback distance. Specifically, while the required setback from the northern planned road is 6.67 meters, measurements showed only 4.86 meters. Red book issuance for these cases can only proceed once the competent construction authority provides a resolution for the violations.
