Urgent Announcement Regarding Immigration and Emigration for All Citizens Nationwide Effective December 15th

Effective from December 15, 2025, Decree 282/2025/NĐ-CP introduces a series of new penalties in the areas of security, order, and social safety. These penalties specifically target actions related to the departure, entry, transit, residence, and movement of Vietnamese citizens and foreigners within Vietnam’s territory.

Fines ranging from 300,000 to 2 million VND for common violations

According to Article 21 of the Decree, foreigners traveling within Vietnam without carrying proper documentation will face a warning or a fine between 300,000 and 500,000 VND.

Several other actions will incur fines from 500,000 to 2 million VND, including:

  • Failing to report a lost passport or travel document.
  • Providing false information to obtain or renew documents.
  • Entering restricted areas without permission.
  • Refusing to present documents when requested by authorities.
  • Foreigners overstaying their visa by less than 16 days.
  • Vietnamese citizens entering the country without valid documents.
  • Seizing or retaining someone else’s travel documents.

Increased penalties for forging and lending documents

Violations such as tampering with passports, renting or lending travel documents, using someone else’s documents to enter or cross borders, or accommodation establishments failing to report the temporary stay of 1-3 foreigners will result in fines ranging from 3 to 5 million VND.

Individuals illegally crossing borders or overstaying their visa by 16-30 days may face fines of 5-10 million VND.

Using counterfeit passports, fake AB stamps, or fraudulent travel documents; overstaying visas by 30-60 days; or accommodation establishments failing to report the stay of 4-8 foreigners will be fined 10-15 million VND.

The Decree also imposes fines of 15-20 million VND on foreigners working or operating in Vietnam without permission, overstaying their visa by 60-90 days, or Vietnamese citizens using fake foreign visas.

Actions such as sponsoring foreigners with false information, entering the country for purposes other than declared, forging documents to obtain a passport, or overstaying a visa by 90-180 days will result in fines of 20-25 million VND.

Maximum fines: 30-40 million VND

Severe violations incurring fines of 30-40 million VND include:

  • Entering diplomatic missions or international organizations without permission.
  • Foreigners residing in prohibited areas.
  • Vehicle owners transporting individuals across borders without completing entry procedures.
  • Organizing or brokering illegal entry or exit, not yet constituting a criminal offense.
  • Failing to comply with deportation orders.
  • Overstaying a visa by one year or more without permission.
  • Illegally crossing borders and remaining in Vietnam without valid documents.

Violations by border residents will be handled according to decrees on border management and protection.

Decree 282/2025/NĐ-CP is seen as a necessary tightening measure to ensure security, closely monitor foreign residents, and reduce document forgery and immigration violations, especially as international travel, tourism, and labor continue to grow.
