Prosecution Initiated in Case of ‘Mistakenly Building’ Nearly 50 Houses on Others’ Land in Ho Chi Minh City

Following a thorough collection of information and evidence, the Ho Chi Minh City Police Investigation Agency has officially initiated criminal proceedings for the case of "Fraudulent Appropriation of Property." This decisive action aims to thoroughly investigate and clarify the actions of Le Van Hoang and his accomplices.

On December 2nd, the Ho Chi Minh City Police Investigation Agency (PCIA) officially initiated a criminal investigation into the case of “Fraudulent Appropriation of Property” involving Le Van Hoang and his accomplices. The case centers around the unauthorized construction of nearly 50 houses on land owned by another individual in Tan Khanh Ward.

Prior to the indictment, in mid-November, the PCIA’s police force conducted a thorough survey of the site, including mapping, photographing the entire area (land plot No. 87, map sheet No. 16 in Tan Khanh Ward), and documenting all 48 structures. Authorities also gathered information from households who had purchased properties within the disputed land.

As previously reported by Tien Phong Newspaper, the Ho Chi Minh City Police dispatched investigators to the site on November 11th to collect evidence and assess criminal charges against Le Van Hoang (born in 1969) for his role in the illegal construction of nearly 50 houses in Tan Khanh Ward.

According to records, in 1999, Truong Minh Ky (born in 1969, residing in Ho Chi Minh City) was granted a land use rights certificate by the People’s Committee of Tan Uyen District (formerly part of Binh Duong Province, now Ho Chi Minh City) for a 6,465 sqm plot (land plot No. 87, map sheet No. 16) in the former Tan Phuoc Khanh Ward.

In 2017, Le Van Hoang and others encroached on a portion of this land to build temporary structures, leading to a dispute with Mr. Ky. In 2019, Mr. Ky filed a lawsuit against Mr. Hoang.

Upon accepting the case, the Tan Uyen District People’s Court (former) issued an emergency injunction prohibiting Mr. Hoang from constructing or assembling prefabricated houses on land plot No. 87. At that time, Mr. Hoang had already built 7 single-story houses and a row of dormitories.

By 2020, when the Civil Judgment Enforcement Agency of Tan Uyen District (former) issued a notice demanding the demolition of illegal structures, the site had 25 completed single-story houses, 2 dormitory buildings, and 5 houses under construction.

Subsequently, Mr. Hoang filed a countersuit, requesting the court to revoke Mr. Ky’s land use rights certificate. However, his claim was dismissed. By this time, 48 illegally constructed houses were present on the land.

In 2023, the Tan Uyen City People’s Court (former) reopened Mr. Ky’s case against Mr. Hoang. In July 2024, the court ruled in favor of Mr. Ky, ordering Mr. Hoang and related parties to demolish all structures and return the land to the plaintiff.

In late February 2025, the former Tan Uyen City People’s Court (now the District 17 People’s Court, Ho Chi Minh City) formally requested the PCIA to consider criminal charges against Le Van Hoang for his violations.
