Chairman of Hanoi May Approve Unlimited Capital Investment Projects

According to the draft resolution, the People’s Council and the Chairman of the Hanoi People’s Committee will have the authority to decide on investment policies and approve investment principles for public, PPP, and private projects, regardless of their capital scale or land use requirements.

Doubling Compensation, Support, and Resettlement for Urgent Projects

The draft Resolution piloting special mechanisms and policies for major projects in the capital was reviewed by the National Assembly Standing Committee on December 4th.

During the session, Minister of Finance Nguyen Van Thang stated that the draft Resolution empowers the People’s Council and the Chairman of the City People’s Committee to decide on investment policies and approve projects, including public, PPP, and private initiatives, regardless of capital scale, land use, or resettlement requirements, which typically fall under the jurisdiction of the National Assembly, Government, or Prime Minister.

Additionally, the City People’s Council will establish procedures for project proposal, appraisal, and approval, as well as adjustments to investment policies.

When approving investment policies, special mechanisms may be applied with the consent of competent authorities. The City People’s Committee will report to the Government for submission to the National Assembly Standing Committee.

Regarding planning, the city will develop a single comprehensive plan for the capital, integrating national and regional plans while incorporating the capital’s specific needs and adjustments to the general plan.

On land acquisition, allocation, and leasing, the draft introduces provisions to enhance Hanoi’s autonomy. This includes additional grounds for land recovery beyond those in Article 79 of the Land Law. The City People’s Council will determine projects eligible for land recovery to support economic and social development for national and public interests. The city may also temporarily allocate land within project boundaries to commence construction.

For projects requiring immediate implementation as directed by the Politburo, Party Central Committee’s Secretariat, Government Party Committee, or Hanoi Party Committee, the City People’s Council may approve compensation, support, and resettlement packages up to double the standard rates.

In other cases, based on local realities and budget capabilities, the City People’s Council may approve higher compensation, support, and resettlement packages, not exceeding double the standard rates.

Preventing Complex Complaints and Disputes

During the review, Phan Van Mai, Chairman of the Economic and Financial Committee, expressed support for the Resolution’s urgency and streamlined adoption process. This aims to remove institutional barriers, mobilize resources, and promote the capital’s rapid, sustainable, and modern development.

For significant and complex special mechanisms with broad impact, such as expanded land recovery cases, the reviewing agency recommends reporting to competent authorities and thoroughly assessing legal, economic, and social implications, as well as implementation risks, to prevent complex complaints and disputes.

Subsequently, Chairman of the Hanoi People’s Committee Vu Dai Thang emphasized the city’s 100-year vision planning and urged the National Assembly to adopt the Resolution at the 10th session.

In conclusion, Vice Chairman of the National Assembly Vu Hong Thanh stated that the National Assembly Standing Committee generally agrees with the Government’s proposal, and the dossier is ready for submission to the National Assembly at the 10th session.

Thanh advised the drafting agency to refine the dossier to the highest quality for submission at this session.
