Unlocking Progress: Ho Chi Minh City Resolves Hurdles, Issues Land Titles for Multiple Projects

Introducing a series of prestigious projects now on track for red book issuance, following thorough review by Task Force 1645: the office tower and apartment complex at 39-41-43 Vo Van Kiet Street, Sai Gon Ward; the low-rise residential area in Binh Trung Moi Ward; DEFINE Residence in Cat Lai Ward; and the Sonadezi Huu Phuoc residential zone in Ngai Giao Commune.

Approval of Land Ownership Certificates

Task Force 1645, led by Mr. Nguyễn Toàn Thắng, Director of the Ho Chi Minh City Department of Agriculture and Environment, chaired a meeting to address issues related to land ownership certificates (sổ hồng). Notably, the meeting included projects previously located in Bà Rịa – Vũng Tàu.

Among these, the office building and apartment project at 39-41-43 Võ Văn Kiệt, Sài Gòn Ward, developed by the Vietnam Textile and Garment Group, was discussed. The group had previously been granted a land use rights certificate by the Department of Natural Resources and Environment for over 962 m², designated for business operations (office use).

The office building and apartment project at 39-41-43 Võ Văn Kiệt, Sài Gòn Ward, will receive land ownership certificates.

On January 20, 2017, the Ho Chi Minh City People’s Committee issued Decision No. 331, allowing the Vietnam Textile and Garment Group to change the land use purpose for constructing rentable offices and apartments. The project has since been completed, inspected, and all financial obligations fulfilled.

Mr. Nguyễn Toàn Thắng instructed the developer to report to the Department of Construction regarding social housing obligations and approved the issuance of land ownership certificates for the project.

At the Bình Trưng Mới low-rise residential area in Bình Trưng Ward, developed by Bình Trưng Mới Real Estate LLC, 159 houses (all with land ownership certificates) and a public facility (kindergarten) are included. The project’s total land area is 57,700 m², allocated by the Ho Chi Minh City People’s Committee via Decisions No. 6514 and No. 261. In October 2022, the Department of Natural Resources and Environment issued Land Use Rights Certificate No. CT85741. After reviewing the case, Mr. Nguyễn Toàn Thắng approved the issuance of the requested certificates.

The H1-09 apartment complex in Cát Lái Ward consists of 3 blocks: Block A (16-story commercial building) and two residential blocks with a total of 528 apartments. Land ownership certificates have been issued for 465 out of 528 units. The developer now requests a certificate for the basement parking area (938 m², 63 car spaces), which is owned by the developer as per the sales contract. The 2% maintenance fund was transferred to the management board in August 2022.

The Department of Construction clarified that motorcycle and bicycle parking areas are common property, while car parking spaces can be leased or sold by the developer. Mr. Nguyễn Toàn Thắng approved the issuance of the parking area certificate as requested.

Temporary Structures Must Be Removed

At the DEFINE apartment complex in Cát Lái Ward, developed by CapitaLand – Thiên Đức LLC, there are 88 apartments. A temporary structure (showroom) remains on green space outside the project boundaries, and the 2% maintenance fund has not been transferred.

Mr. Nguyễn Toàn Thắng required the developer to commit to removing the temporary structure and transferring the maintenance fund before issuing land ownership certificates.

The Sonadezi Hữu Phước residential area in Ngãi Giao Commune, developed by Sonadezi Châu Đức JSC, includes approximately 1,870 housing units (657 townhouses and 1,213 apartments).

Section II of Document No. 1416 from the Bà Rịa – Vũng Tàu Department of Construction (now the Ho Chi Minh City Department of Construction) states: “Based on Article 55 of the Law on Real Estate Business and Article 19 of Decree No. 99, and given the completed and inspected technical infrastructure, 75 shophouse units are classified as commercial housing.”

The Department of Construction has not yet determined the conditions for selling, leasing, or lease-purchasing future housing units for these 75 shophouses under the Law on Real Estate Business.

The Ho Chi Minh City Land Registration Office (Branch 3) requested the Department of Construction’s opinion on the conditions for selling, leasing, or lease-purchasing future housing units for the 75 shophouses to process land use rights transfers. However, no response has been received from the Department of Construction.

Mr. Nguyễn Toàn Thắng instructed the developer to re-engage with the Department of Construction to resolve this issue and proceed with issuing the requested certificates.
