No Children Under 10 Allowed in the Front Seat: A Crucial Rule for Drivers

When transporting children under 10 years old and shorter than 1.35 meters in a car, drivers must not allow them to sit in the same row, except in vehicles with only one row of seats, as per the newly amended law passed by the National Assembly.

On the morning of December 10th, with an overwhelming majority of delegates in favor, the National Assembly passed the Law on Amendments and Supplements to several articles of 10 laws related to security and public order.

Regarding the Law on Amendments and Supplements to the Road Traffic Order and Safety Law, it stipulates: “When transporting children under 10 years old and under 1.35 meters tall in a car, the driver must not allow the child to sit in the same row, except in cars with only one row of seats.”

Additionally, drivers are required to use and instruct the use of appropriate safety devices for children, except in passenger transport vehicles.

The law mandates that freight transport vehicles, passenger transport vehicles under 8 seats (excluding the driver’s seat), tractor-trailers, ambulances, and internal transport vehicles must be equipped with journey monitoring devices and driver image recording devices.

For passenger transport vehicles with 8 seats or more, the installation of journey monitoring devices, driver image recording devices, and passenger compartment image recording devices is required.

The handling of data collected from driver image recording devices and passenger compartment image recording devices shall be carried out in accordance with the provisions of the law on personal data protection and other relevant legal regulations.

Explaining this provision, the drafting committee stated that the cost of a camera is approximately VND 1,000,000 – 1,500,000 per vehicle. The cost of data storage devices (64-128GB memory cards) is around VND 200,000 – 300,000 per vehicle.

The total estimated cost nationwide is VND 151 – 217 billion, averaging VND 1.2 – 1.8 million per vehicle.

Currently, there are approximately 300,000 freight transport vehicles and passenger transport vehicles under 8 seats. The installation of driver image recording cameras will incur these two costs. The total estimated cost is VND 360 – 540 billion.

Although the regulation on installing driver image recording cameras and passenger compartment cameras has financial implications, the drafting committee believes it will have a positive impact on business operations, enhance transparency, reduce legal risks, and improve the quality of transport services. Consequently, it will help reduce traffic accidents, minimizing damage to health, life, and the economy.

The law passed by the National Assembly will take effect from July 1, 2026.
