North Ninh Cancels Hundreds of Contracts, Reclaims Numerous Social Housing Units

During the eighth session of the 19th term of the Bac Ninh Provincial People’s Council (December 10), delegates highlighted issues of ineligible buyers purchasing social housing and instances of policy exploitation. This concern has garnered significant attention from constituents as the province accelerates its social housing development initiatives.

In response to inquiries, Nguyen Viet Hung, Director of the Bac Ninh Department of Construction, emphasized that the approval process for social housing buyers is strictly outlined in the 2023 Housing Law and Decree 100/2024/NĐ-CP.

Within 30 days of a project’s commencement, developers must publicly disclose all project details for residents to monitor and prepare their applications. Buyer applications must be verified by labor agencies, local People’s Committees, or police stations, and Social Insurance offices, depending on the case, to confirm eligibility, housing status, and income.

According to Mr. Hung, after receiving applications, developers must scrutinize and submit them to the Department of Construction for inter-agency review to exclude individuals who have previously benefited from similar policies. Only eligible applicants with official approval from the department may proceed to sign purchase agreements.

The Department of Construction has taken stringent action against violations, canceling hundreds of contracts and reclaiming numerous units in projects such as Bac Tu Son (54 units), Tan Hong Ward (7 units), Khac Niem Ward (9 units), Nen Town Worker Housing (95 contracts), and Tran Nguyen Han Ward Residential Area 3. The Social Policy Bank has also recovered associated preferential loans.

“We mandate that developers remove ineligible names, cancel contracts, and collaborate to revoke Certificates of Eligibility and decisively address policy exploitation,” Mr. Hung stressed.

Recently, social media platforms have featured unauthorized deposit collection, reservation holding, and receipt issuance for several social housing projects in the province, despite these projects not meeting sales eligibility criteria.

Investigations by the Department of Construction revealed that while developers have not signed contracts or accepted payments, individuals and organizations have independently established advisory points, advertised, and collected reservations in violation of regulations.

The Department of Construction has collaborated with the Bac Ninh Provincial Police to inspect, address, and issue directives to developers and local authorities, particularly in Vu Ninh Ward, Dai Phuc Ward, and Areas 5 and 9 of Bac Giang Ward.

To combat exploitation, the Department of Construction has implemented measures such as full process transparency, publishing lists of eligible projects and approved buyers on the Electronic Information Portal.

People’s Committees, ward and commune police, and labor management agencies are tasked with rigorously evaluating applications. Developers are prohibited from accepting applications through intermediaries.

Relevant agencies are developing a social housing database integrated with population, land, tax, and insurance data to enable online approval, conduct regular and unannounced inspections, and strictly penalize unauthorized deposit collection and capital mobilization under Decree 16/2022/NĐ-CP. Cases with fraud indicators will be referred for investigation. Periodic inspections of social housing usage, combined with utility data analysis, will identify illegal subletting, leading to decisive reclamation and public disclosure of violations.

Mr. Nguyen Viet Hung confirmed that social housing sales conditions are clearly defined in the 2023 Housing Law: Future properties must have completed foundation work and infrastructure according to schedule; existing properties must have finished infrastructure and be free of disputes; all must receive eligibility confirmation from the Department of Construction.

“Developers are strictly prohibited from accepting deposits, holding reservations, or engaging in unauthorized capital mobilization. Upon detecting individuals or organizations falsely claiming to represent developers to collect funds, we will immediately collaborate with police for enforcement,” Mr. Hung stated.

Moving forward, the Department of Construction will continue advising the Provincial People’s Committee to refine social housing policies tailored to local conditions and propose amendments to the Ministry of Construction to prevent short-term reselling and unauthorized renting.

“The province is committed to ensuring that policies benefit genuinely needy residents while firmly addressing exploitative acts that undermine social welfare,” Mr. Nguyen Viet Hung affirmed.
