One of the significant updates to the law is the expansion of eight categories of construction projects exempt from building permits, including those under special public investment projects and single-family homes under seven stories.
The first category includes state-secret projects; emergency construction projects; projects under special public investment or special investment procedures; temporary structures; and projects on defense and security land.
The second category covers public investment projects approved by competent authorities such as the Prime Minister, heads of central agencies, chief justices, the State Auditor General, the President’s Office, the National Assembly Office, ministries, sectors, political-social organizations, and provincial People’s Committee chairpersons.
The third category includes linear projects spanning two or more provinces; and projects outside urban development zones as per approved plans or approved route schemes.
The fourth category comprises offshore construction projects in designated sea areas; airports, airport facilities, and aviation support structures outside airports.
The fifth category includes advertising structures not requiring permits under the Advertising Law; and passive telecommunications infrastructure.
The sixth category covers projects with feasibility studies or adjustments approved by specialized agencies.
The seventh category exempts level-4 constructions; single-family homes under seven stories with less than 500m² floor area, provided they are not in architecturally regulated areas such as functional zones, urban areas, rural residential areas, provincial/city urban development zones, special economic zones, national tourism areas, or areas with established architectural management regulations.
The eighth category includes repairs or renovations inside buildings or exterior renovations not facing urban roads with architectural requirements. Repairs must not alter the purpose, function, or structural integrity, and must ensure fire safety, environmental compliance, and technical infrastructure.
With 437 out of 439 votes in favor, the National Assembly passed the amended Construction Law, effective from July 1, 2026.
