Civil Servants Eligible for Exclusion, Exemption, and Reduced Liability

The Civil Service Law, passed by the National Assembly during its 10th session, introduces significant updates regarding civil servants’ rights in professional activities, salary structures, bonuses, and overtime compensation.

In professional activities, the law ensures civil servants are protected by law, treated equally in career development, and provided with training to enhance their expertise. They are also guaranteed necessary equipment, work conditions, and relevant job-related information.

Additionally, civil servants have the authority to make professional decisions related to their tasks and can refuse assignments deemed unlawful. They may also terminate employment contracts unilaterally, subject to legal provisions, and seek exclusion, exemption, or reduced liability as per the law and competent authorities.

State civil servants enjoy additional rights as stipulated by labor laws and relevant regulations.

Notably, the Civil Service Law dedicates a section to salary, bonuses, and related benefits. Civil servants receive compensation based on performance and job responsibilities, including overtime pay, night shift allowances, and other benefits as per internal regulations.

Those working in remote areas, border regions, or challenging sectors receive special allowances as outlined in the law.

Civil Servants Permitted to Invest and Manage Businesses

The new law clarifies civil servants’ rights to engage in professional and business activities. They may enter labor or service contracts with other entities, provided there is no conflict of interest, and obtain written approval from relevant authorities when necessary.

Civil servants can also practice their profession individually, invest in, and manage businesses, cooperatives, private hospitals, educational institutions, or research organizations, unless prohibited by anti-corruption or sector-specific laws.

Those in public science and technology units or state universities may exercise additional rights under relevant laws. The Civil Service Law takes effect on July 1, 2026.

Civil servants are entitled to annual leave, public holidays, personal leave, and unpaid leave as per labor laws. Unused annual leave days will be compensated financially, subject to internal regulations and the unit’s financial capacity.
