Vietnamese Businesswoman Nguyen Thi Nhu Loan Pays VND 100 Billion in Restitution for Legal Case

According to investigative authorities, Ms. Nguyễn Thị Như Loan, Chairwoman of Quốc Cường Gia Lai Company, has submitted 100 billion VND to address the consequences of the case. Numerous related properties have been temporarily suspended from transactions.

As reported by VietNamNet, the Investigation Police Agency (IPA) of the Ministry of Public Security has completed its investigation and proposed the prosecution of Mrs. Nguyen Thi Nhu Loan, Chairwoman of the Board of Directors and CEO of Quoc Cuong Gia Lai Corporation, along with 21 other defendants on five charges.

According to the IPA, the defendants and their families have paid over VND 223 billion and USD 64,000 to mitigate the consequences. Additionally, the IPA has seized nine assets, which are land use rights valued at over VND 413 billion, to ensure the fulfillment of obligations by defendants Nguyen Thi Nhu Loan, Le Y Linh (former Director of Viet Tin LLC), and Dang Phuoc Dua (former Chairman of Viet Tin JSC).

Furthermore, the IPA has temporarily suspended transactions on several properties owned by Mrs. Loan, including real estate in Long An, a house and land at 26 Tran Quoc Thao (Ho Chi Minh City), and a property in the Han River Tourism Area (Da Nang).

Mrs. Loan’s criminal actions caused a loss of over VND 542 billion to the State, while she personally profited more than VND 297 billion. Her family has paid VND 100 billion to rectify the damages caused by the case.

In this case, the IPA determined that the Ho Chi Minh City People’s Committee allocated land to Phu Viet Tin Corporation without meeting the legal requirements. Specifically, at the time of the land allocation decision on March 25, 2010, the company had not yet had an approved investment project; the land area lacked detailed urban planning and was not included in the district-level land use plan, thus violating the 2003 Land Law.

According to the IPA, the responsibility lies with the following individuals: Nguyen Thanh Tai (former Standing Vice Chairman of the Ho Chi Minh City People’s Committee), Nguyen Thanh Nhan (former Deputy Director of the Department of Natural Resources and Environment), Nguyen Nhu Binh (former Deputy Head of the Land Registration and Economics Division – Department of Natural Resources and Environment), Bui Duy Bao Ngoc (former specialist in the Land Registration and Economics Division – Department of Natural Resources and Environment), Huynh Kim Phat (former Deputy Chief of the Office of the Ho Chi Minh City People’s Committee), and Vu Ngoc Hong (former specialist in the Office of the Ho Chi Minh City People’s Committee).

Their actions show signs of violating the regulations on land management, as stipulated in Article 174 of the 1999 Penal Code, with a maximum penalty of up to 7 years in prison. However, the statute of limitations for criminal prosecution has expired.

During the investigation, defendant Dang Phuoc Dua admitted to giving money and promising material benefits to Nguyen Thanh Tai, Nguyen Thanh Nhan, and Huynh Kim Phat. However, aside from this confession, the IPA lacks additional evidence to pursue criminal charges against these individuals.

Regarding individuals from the Ho Chi Minh City People’s Committee and its affiliated units, including Nguyen Huu Tin (former Vice Chairman of the Ho Chi Minh City People’s Committee), Tran Chi Dung (former Director of the Department of Planning and Architecture), and Ta Quang Vinh (former Deputy Director of the Department of Finance), the investigation included Dua’s testimony about providing money and promising material benefits during the processing of project-related procedures.

However, aside from this testimony, the IPA lacks sufficient evidence to pursue criminal charges.

During the investigation, the Investigation Police Agency of the Ministry of Public Security also identified signs of violations related to the conversion of 159 resettlement apartments into commercial sales. As the investigation period has expired, the IPA has separated the relevant files and documents for further investigation and handling.
