“Ho Chi Minh City Secretary: Flexible Mechanisms Needed for Land Subdivision Inherited from Ancestors”

Secretary of the Ho Chi Minh City Party Committee, Tran Luu Quang, emphasized the need to explore flexible and exceptional mechanisms for land subdivision inherited from grandparents or parents. This approach aims to resolve current obstacles and enable citizens to promptly address their land-related issues.

On the morning of December 16th, Mr. Tran Luu Quang, Secretary of the Ho Chi Minh City Party Committee, along with delegates from Group 12 of the Ho Chi Minh City National Assembly Delegation, met with constituents in Dong Hoa Ward following the 10th session of the 15th National Assembly.

The meeting was attended by constituents from both Dong Hoa and Di An Wards.

During the session, constituents raised concerns regarding land law enforcement challenges following administrative boundary adjustments. A key issue was the division of family-inherited land for descendants.

Constituent Tran Thi Quynh Mai from Di An Ward highlighted that many long-standing family plots, passed down through generations, lack access to public roads. This makes it difficult to meet current land division requirements when transferring ownership to heirs.

“There are two types of access: one for subdivided plots within planned areas, and the other for family-inherited land. Does the latter fall under the same regulations as subdivided plots? This creates difficulties for families,” Ms. Mai stated.

Ms. Mai clarified that this land is for family residence, not for subdivision or real estate speculation. However, strict application of the regulations would significantly hinder lawful land use rights.

She proposed exceptions for family-inherited land, allowing division even with internal access only.

Many constituents echoed Ms. Mai’s concerns, emphasizing that land regulations should protect citizens’ rights. Current rules, they argued, prevent lawful land use.

Mr. Tran Luu Quang acknowledged that land laws aim to prevent excessive land fragmentation. However, he recognized the need to address specific historical and usage contexts.

He cited a successful model from former Binh Duong Province, where a council reviewed cases not fully meeting regulations but with stable, long-term usage, avoiding new infrastructure development.

This approach effectively resolved citizen issues while maintaining state management requirements.

Mr. Quang pledged to advocate for mechanisms addressing similar cases, ensuring citizens can exercise their legal rights to inherited land.

He directed relevant agencies to compile constituent feedback and develop solutions balancing land management with citizen rights.

During the meeting, Mr. Quang assured constituents that their input would be forwarded to appropriate authorities for response.

He praised Di An and Dong Hoa Wards for their unique characteristics and commended constituents for their insightful, practical contributions. He noted their engagement demonstrated a strong commitment to constructive dialogue and community improvement.

“As both a National Assembly delegate and Party Secretary, we make promises we can keep. We commit only to what falls within our responsibility and ensure fulfillment,” Mr. Quang emphasized.
