“Over 50% Public Approval Required to Finalize Provincial and Communal Merger and Renaming Proposals”

The government has recently issued Decree No. 321/2025, which outlines the process for gathering public input on the establishment, dissolution, merger, division, boundary adjustment, and renaming of administrative units.

The decree stipulates that in cases of establishing, dissolving, merging, dividing, adjusting boundaries, or renaming provincial-level administrative units, the Provincial People’s Committee (PPC) shall organize the collection of public opinions from all commune-level administrative units within that province.

For establishing, dissolving, merging, dividing, adjusting boundaries, or renaming commune-level administrative units, the PPC shall organize the collection of public opinions from the specific commune-level administrative unit involved.

The PPC shall collect public opinions by distributing opinion forms to households according to the prescribed template.

The PPC shall decide on suitable methods to distribute opinion forms to each household or delegate this task to the Commune People’s Committee (CPC) for specific units, encouraging the use of electronic opinion collection methods via local electronic information pages or portals, legally operating telecommunications or social networks, and authorized electronic software.

This process must ensure transparency, convenience, and alignment with the level of information technology application at the commune, village, or neighborhood levels.

Procedures for Collecting Opinions

After drafting the plan for establishing, dissolving, merging, dividing, adjusting boundaries, or renaming administrative units, the PPC shall issue a document accompanied by opinion forms and relevant materials to the CPC, guiding them to develop a plan and organize the collection of public opinions by village or neighborhood.

Within 60 days from receiving the PPC’s document, the CPC must complete the public opinion collection process.

Within 5 working days from completing the public opinion collection, the CPC shall synthesize and submit a report on the results to the People’s Council of the same level, the PPC, and publish it on the CPC’s electronic information page or portal.

For commune-level administrative units without a People’s Council, the CPC shall synthesize and submit the public opinion collection report to the PPC and publish it on the CPC’s electronic information page or portal.

Within 5 working days from receiving the CPC’s report, the PPC shall direct the synthesis of a comprehensive report on public opinion collection results from relevant commune-level administrative units, submitting it to the People’s Council of the same level, the Government’s electronic information portal, and the PPC’s electronic information page or portal.

Within 5 working days from receiving the public opinion collection reports from the PPC, CPC, the Government’s electronic information portal, and local electronic information pages or portals, these entities are responsible for publishing the results.

The report on public opinion collection results regarding the establishment, dissolution, merger, division, boundary adjustment, or renaming of administrative units must clearly state the organization process, total number of households in the area, number of participating households, number of agreeing households, number of disagreeing households for each commune-level administrative unit, and any other opinions (if applicable).

If the public opinion collection results for establishing, dissolving, merging, dividing, adjusting boundaries, or renaming provincial-level administrative units achieve at least 50% approval from the total households in the area (calculated per provincial-level administrative unit), the drafting agency shall finalize the plan and submit it to the Provincial People’s Council for consideration and feedback.

If the public opinion collection results for establishing, dissolving, merging, dividing, adjusting boundaries, or renaming commune-level administrative units achieve at least 50% approval from the total households in the area (calculated per commune-level administrative unit), the drafting agency shall finalize the plan and submit it to the Provincial and Commune People’s Councils for consideration and feedback.

For commune-level administrative units without a People’s Council, the PPC shall direct the finalization of the plan and submit it to the Provincial People’s Council for consideration and feedback.

The public opinion collection results must be published on local electronic information pages or portals and the Government’s electronic information portal.
