Prominent Figures, Including Pham Thai Ha and Former Chairman of Thuan An Group, Receive Sentence Reductions

Despite withdrawing his appeal, Mr. Phạm Thái Hà, former Deputy Head of the National Assembly Office, received a reduced sentence during the appellate trial as the court considered several mitigating circumstances.

This morning (December 24), the Supreme People’s Court of Vietnam’s Appellate Division in Hanoi handed down sentences to 14 defendants in the case involving Thuan An Corporation, all of whom had filed appeals. The appellate panel accepted the appeals of all defendants and also reduced sentences for those who did not file appeals or withdrew their appeals.

The appellate panel issued the following sentences:

Nguyen Duy Hung (former Chairman of Thuan An Corporation): 7 years and 6 months in prison (reduced from the initial 10 years and 6 months).

Pham Thai Ha (former Deputy Chief of the National Assembly Office): 4 years and 9 months in prison, plus a 100 million VND fine (reduced from 5 years and 6 months).

Le O Pich (former Deputy Chairman of Bac Giang Province People’s Committee): 2 years and 3 months in prison (reduced from 3 years).

Tran Thanh Quang (former CEO of Thuan An Corporation): 5 years in prison. Both Hung and Quang are banned from participating in bidding activities for 2 years.

Other defendants also received reduced sentences as follows:

Nguyen Ngoc Hoa (former Chairman of 168 Vietnam Company): 3 years of suspended sentence.

Pham Hoang Tuan (former Director of Hanoi Project Management Board): 4 years in prison.

Vu Hai Tung (former Head of Road Construction Management Division, Vietnam Road Administration): 2 years and 3 months in prison.

Nguyen Van Thao (former Director of Bac Giang Project Management Board): 4 years and 9 months in prison.

Tran Viet Cuong (former Director of Tuyen Quang Project Management Board): 4 years and 6 months in prison.

Dam Van Cuong (former Deputy Director of Bac Giang Project Management Board): 4 years in prison.

Pham Thanh Binh (former Director of Quang Ninh Project Management Board): 3 years and 9 months in prison.

The appellate panel noted that by the time of the appeal, all defendants had compensated for the damages caused to the state budget and returned their illicit gains. Several defendants presented new mitigating circumstances, and many were recognized for their contributions to their localities. Additionally, several organizations submitted petitions for leniency, which were considered in reducing the sentences.

For defendants who did not file appeals, the panel still reduced their sentences, considering their subordinate roles, minor involvement, and efforts to rectify the damages caused.

The panel also acknowledged that Nguyen Duy Hung had compensated an additional 47 billion VND during the appellate hearing.

According to the initial verdict, during the bidding, winning, and execution of contracts for projects in former Bac Giang Province, Tuyen Quang, Quang Ninh, Hanoi, and the former Ministry of Transport, Nguyen Duy Hung exploited his close relationships with high-ranking officials, including Pham Thai Ha, to secure introductions, interventions, and influence over provincial and ministerial leaders, thereby facilitating Thuan An Corporation’s participation in bidding, contract wins, and project execution.

The defendants’ actions were deemed particularly serious, violating regulations on transparency and fairness in bidding processes, undermining economic development, tarnishing the reputation of state agencies, and causing over 120 billion VND in damages to the state.
