On December 25, the Hanoi People’s Procuracy (VKSND) announced the indictment of Le Thanh Than, Chairman of the Board and CEO of Bemes Company, as well as Chairman of Muong Thanh Group, on charges of defrauding customers.

In the same case, the VKSND also indicted Do Van Hung, former Chairman of Kien Hung Ward People’s Committee, along with former Vice Chairmen Nguyen Duy Uyen and Bui Van Bang; Vuong Dang Quan, former Deputy Chief of Ha Dong District Construction Inspectorate; and Nguyen Van Nam, former Chief of Ha Dong District Construction Inspectorate, all on charges of negligence causing serious consequences.
Le Thanh Than was initially charged on July 5, 2019, and placed under a travel ban. The case has spanned six years, with multiple instances of the prosecution returning the case for additional investigation.
Most recently, on August 10, 2023, the Hanoi People’s Court began proceedings, but the presiding judge announced that certain issues could not be clarified in court. As a result, the case was returned for further investigation.
According to case files, between 2009 and 2012, the government implemented measures to expedite investment and construction projects by simplifying administrative procedures.
The CT6 Kien Hung project had been approved by the former Ha Tay Provincial People’s Committee with a detailed 1/500 construction plan on land managed by Bemes Company, which was later incorporated into Hanoi.
After acquiring Bemes Company, Le Thanh Than exploited the simplified administrative procedures for urban and housing projects. He rapidly developed the CT6 Kien Hung project, severely violating the approved detailed construction plan.
Despite lacking approval from competent authorities to amend the construction plan, the Muong Thanh Group chairman continued to direct the project’s construction outside the approved plan. He then sold all illegally established apartments, profiting unlawfully. Hundreds of these apartments were sold without land-use rights certificates from the former Hanoi Department of Natural Resources and Environment, causing customers losses amounting to hundreds of billions of Vietnamese dong.
Prosecutors attributed the violations to the negligence of former Kien Hung Ward officials and Ha Dong District construction inspectors. Throughout the project’s construction, which deviated from the approved plan, these officials failed to conduct inspections or take preventive measures.
