Da Nang: Unlicensed Construction Rampant in Thanh Vinh Industrial Cluster

The Da Nang Inspectorate has uncovered unauthorized construction activities by several companies, including Dinco Corporation and Dufago Concrete, within the Thanh Vinh Industrial Cluster. These firms were found to have erected multiple structures without the required permits.

On December 25th, the Da Nang Inspectorate released its findings on the compliance with legal regulations regarding land management and usage by 12 companies within the expanded Thanh Vinh Industrial Cluster in Lien Chieu Ward.

The Thanh Vinh Industrial Cluster (TVIC), developed by Da Nang – Central Investment Joint Stock Company (DMT), began in 2007 and became operational in 2009.

The Inspectorate concluded that the Da Nang People’s Committee’s issuance of 61 land use certificates to Dinco and DMT for plots within TVIC, with indefinite land use terms, was non-compliant.

At the time of inspection, 9 out of 16 land-using enterprises had not adjusted their land use terms, violating regulations.

Additionally, TVIC falls within an area rezoned in 2021. However, the project remains unimplemented, causing difficulties for land users.

Regarding environmental compliance, the Inspectorate found that most operating businesses lacked environmental documentation, had insufficient green space, and discharged untreated wastewater into the cluster’s common drainage system.

Notably, several companies violated construction regulations: Da Nang Electrical and Mechanical Plating Construction JSC; Khatoco Da Nang Branch; Nga Tuan JSC; Dinco Construction Technology JSC; Thanh Phu Ltd.; Lien Chieu Green Transport JSC; and Dufago Concrete Ltd. constructed without permits or beyond permitted boundaries.

Most businesses within TVIC lacked environmental and fire safety documentation.

The Inspectorate also found that Dinco Construction Technology JSC leased plot C-20 to Dufago Concrete Ltd., a subsidiary of Din Capital Group, for a concrete plant (built in 2009) without a construction permit. Dufago also used 7,298m² for material storage beyond the leased area.

The Da Nang Inspectorate urged DMT to rectify issues, ensure tenants adjust land use terms, pay infrastructure fees, and comply with environmental and fire safety regulations.

All involved entities must implement these measures and report back within 15 days of the Inspectorate’s public announcement.
