Nha Trang Airport Case: Two Former Major Generals Face 2–3 Year Prison Sentences

The Military Procuracy representative has proposed sentencing for former Major General Hoàng Viết Quang and Nguyễn Duy Cường on charges of Violating Land Management Regulations.

On the afternoon of January 7th, the Military Procuracy of Military Region 5 proposed sentencing recommendations for nine defendants involved in the Phuc Son Group’s acquisition of 63 hectares of defense land at Nha Trang Airport.

The Military Procuracy recommended that the People’s Court sentence two former Major Generals, Hoang Viet Quang (former Deputy Director of the Operations Department, Ministry of National Defense) and Nguyen Duy Cuong (former Principal of the Air Force Officer School), to 2 years and 6 months to 3 years in prison for Violation of Land Management Regulations.

Four former leaders and officials of Khanh Hoa Province also faced similar charges. Specifically, former Chairman of the Khanh Hoa Provincial People’s Committee Nguyen Chien Thang was recommended to serve 4 to 4 years and 6 months in prison; former Chairman Le Duc Vinh, 3 years and 6 months to 4 years; former Vice Chairman Dao Cong Thien and former Director of the Department of Natural Resources and Environment Vo Tan Thai, both 3 years and 6 months to 4 years.

These former officials are already serving 3-4 sentences totaling 13 to 22 years and 6 months in prison for land-related violations in the province.

The Military Procuracy proposed sentences for three defendants charged with Fraud to Appropriate Property: Nguyen Van Hau, Chairman of Phuc Son Group (12-13 years, combined with a previous 30-year sentence for bribery in 2025, totaling 30 years); Nguyen Thi Hang (Hau’s sister), Deputy General Director of Phuc Son Group (7-8 years, combined with a previous 4 years and 6 months, totaling 11 years and 6 months to 12 years and 6 months); and Tran Huu Dinh, Director of Nam A Investment Company (8-9 years).

Regarding civil liability, the prosecution recommended that Nguyen Van Hau fully compensate for the damages, totaling 6.691 trillion VND after accounting for payments already made.

According to the Procuracy, the defendants committed two violations: illegally transferring nearly 63 hectares of defense land to Phuc Son Group in 2016, and Nguyen Van Hau subdividing and selling the land prematurely, earning over 7.032 trillion VND.

The defendants’ actions were deemed particularly severe, undermining the credibility of involved organizations, negatively impacting the local investment environment and socio-economic development, and eroding public trust.

The defendants charged with land-related violations held high-ranking positions and were responsible for strategic planning but failed to fulfill their duties.

“The defendants were fully aware but deliberately proceeded, allowing the illegal transfer of land to Phuc Son Group,” stated the prosecutor.

The three defendants charged with fraud appropriated a substantial amount of property, causing financial hardship to victims and damaging the reputation of the military.

The prosecutor attributed the case to inadequate and overlapping land laws, complicating land allocation and recovery processes. The defendants, despite their authority over public asset management, failed to adhere to regulations, leading to resource wastage. Additionally, lax real estate market oversight in Khanh Hoa allowed unqualified businesses to operate, unchecked deposit transactions, and insufficient penalties for violations.

Unregulated real estate brokerage, particularly by freelance agents, further exacerbated the issue.
